【摘要】：《勞動(dòng)合同法》第九條的規(guī)定使用人單位化解員工誠實(shí)風(fēng)險(xiǎn)的途徑主要落在了員工誠實(shí)保證保險(xiǎn)身上。國內(nèi)雖然借鑒域外做法開辦了該種保險(xiǎn),但仍缺乏明確的法律依據(jù),一些基本問題,如員工身份、責(zé)任范圍及其例外、損失的發(fā)現(xiàn)、通知與證明等,也缺乏完整的理論構(gòu)建。
[Abstract]:Article 9 of the Labor contract Law makes the way for the employer to dissolve the risk of employee honesty mainly falls on the employee's honesty guarantee insurance.Although this kind of insurance has been established in our country for reference from the overseas practice, it still lacks clear legal basis, and some basic problems, such as employee identity, scope of responsibility and its exception, discovery of loss, notice and proof, also lack of complete theoretical construction.
