【摘要】:正主持人:《勞動(dòng)合同法》第三十七條規(guī)定:"勞動(dòng)者提前三十日以書面形式通知用人單位,可以解除勞動(dòng)合同。"此為通知解除勞動(dòng)合同方式,勞動(dòng)者必須提前履行通知義務(wù)。某用人單位與其職工簽訂的勞動(dòng)合同中也有同樣約定!秳趧(dòng)合同法》第三十八條規(guī)定,用人單位有"未按照勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件""未及時(shí)足額支付勞動(dòng)報(bào)酬"等情形之一的,勞動(dòng)者可以立即解除勞動(dòng)合同,此為即時(shí)解除勞動(dòng)合同方式。那么,勞動(dòng)者能否依據(jù)勞動(dòng)合同上述約定及《勞動(dòng)合同法》第三十八條規(guī)定(用人單位拖
