【摘要】：自格式條款出現(xiàn)以來(lái),在各行業(yè)被廣泛使用,發(fā)揮著重要作用。由于格式條款是一把雙刃劍,因此,我們不僅要促進(jìn)格式條款積極功能的實(shí)現(xiàn),還要對(duì)其弊端加以合理規(guī)制,這樣可以切實(shí)保護(hù)弱勢(shì)群體利益,實(shí)現(xiàn)真正合同自由與正義。
[Abstract]:Since the terms of format have been widely used in various industries , it plays an important role . As the format clauses are a double - edged sword , we should not only promote the realization of the positive function of the format clause , but also make reasonable regulation of its disadvantages so that the interests of the vulnerable groups can be effectively protected and the freedom and justice of the real contract can be realized .
