【摘要】：我國《合同法》規(guī)定了締約過失責(zé)任,但是對其損失的賠償范圍,包括如何確定機會損失等問題,并沒有規(guī)定。為了更明確地界定締約過失損失的范圍,對締約過失責(zé)任的定義、性質(zhì)以及確定損失范圍的原則等問題進行了探討,并且通過一個典型的例子具體分析了機會損失如何計算較為合理。
[Abstract]:The contract Law of our country stipulates the liability for fault in contracting, but the scope of compensation for its loss, including how to determine the loss of opportunity, is not stipulated. In this paper, the definition, nature and principle of determining the scope of loss are discussed, and how to calculate opportunity loss is analyzed through a typical example.
