勞務(wù)派遣“三性”問(wèn)題研究——以《勞動(dòng)合同法》第66條為切入點(diǎn)

【摘要】:我國(guó)對(duì)勞務(wù)派遣采取了嚴(yán)格的立法限制,但是系列法律規(guī)定的出臺(tái)沒(méi)有真正解決勞務(wù)派遣"三性"崗位規(guī)定的問(wèn)題,其自身的模糊與沖突以及實(shí)施中"真派遣、假外包"的問(wèn)題仍大量存在,不斷侵蝕著勞動(dòng)者的合法權(quán)益,域外放松甚至取消勞務(wù)派遣適用范圍限制的立法實(shí)踐經(jīng)驗(yàn)值得我們思考。在現(xiàn)實(shí)語(yǔ)境下,本文認(rèn)為勞務(wù)派遣"三性"規(guī)定最終還是要回歸到實(shí)現(xiàn)被派遣勞動(dòng)者的同工同酬,才能真正地實(shí)現(xiàn)對(duì)勞動(dòng)者權(quán)益的保障,促進(jìn)勞動(dòng)力市場(chǎng)的繁榮和社會(huì)經(jīng)濟(jì)的發(fā)展。
[Abstract]:China has adopted strict legislative restrictions on labor dispatch, but the introduction of a series of laws and regulations has not really solved the problem of "three characteristics" of labor dispatch, its own ambiguity and conflict, and the implementation of "true dispatch". The problem of fake outsourcing still exists in a large number, eroding the legitimate rights and interests of workers, relaxing and even abolishing the limitation of the applicable scope of labor dispatch outside the country. This paper holds that the "three sex" regulations of labor dispatch should finally return to the realization of equal pay for equal work of dispatched workers, so as to realize the protection of workers' rights and interests and promote the prosperity of labor market and the development of social economy.
