【摘要】：正違約責任與侵權(quán)責任競合是民事責任競合中的一種�！逗贤ā返�122條之規(guī)定是民事法律第一次對違約責任與侵權(quán)責任競合的規(guī)定,該規(guī)定及其司法解釋賦予了當事人選擇權(quán),強化了強求權(quán)的效力。然而,現(xiàn)行司法實踐中,在很多情形下,無論當事人如何選擇請求權(quán),都難以獲得周全的救濟。法律對侵權(quán)責任與違約責任競合制度的規(guī)定侵權(quán)責任是指行為人的不法行為侵害了他人物權(quán)、知識產(chǎn)權(quán)或者人身權(quán)而產(chǎn)生的民事責任。違約責
[Abstract]:The concurrence of the liability for breach of contract and the liability of tort is one of the concurrence of civil liability. The 122nd provision of the contract law is the first time that civil law stipulates concurrence of liability for breach of contract and tort liability. The provision and judicial interpretation give the parties the right to choose and strengthen the effectiveness of the right to impose. However, in the current judicial practice, in many cases, no matter how the litigants choose the right of request, it is difficult to obtain complete relief. The law stipulates the concurrence system of liability for tort and liability for breach of contract. Tort liability refers to the civil liability arising from the wrongful act of the actor, which infringes upon his personal rights, intellectual property rights or personal rights.
