【摘要】：冷戰(zhàn)結(jié)束以后,為保護(hù)國(guó)內(nèi)人民免遭嚴(yán)重的人權(quán)侵害,在已有的國(guó)際人權(quán)法與人道法的基礎(chǔ)上,國(guó)際社會(huì)開始逐步提出和實(shí)踐"保護(hù)的責(zé)任"的觀念和原則。但是,即便是在日益強(qiáng)化的人權(quán)國(guó)際保護(hù)的沖擊、影響下,不干涉內(nèi)政原則的基礎(chǔ)地位依然沒有發(fā)生根本動(dòng)搖。因此,不干涉內(nèi)政原則的解釋適用與人權(quán)國(guó)際保護(hù)之間的緊張關(guān)系日益突出。在人權(quán)保護(hù)領(lǐng)域,對(duì)于不干涉內(nèi)政原則的內(nèi)涵構(gòu)造及其解釋適用,國(guó)際社會(huì)應(yīng)當(dāng)確立一種動(dòng)態(tài)的具有彈性的原則框架結(jié)構(gòu)。由于"保護(hù)的責(zé)任"情勢(shì)下的外部介入是一個(gè)連續(xù)的綜合的方法與過程,國(guó)際社會(huì)應(yīng)當(dāng)以正當(dāng)理由和依據(jù)的尋求和博弈為基礎(chǔ),形成一種對(duì)話、溝通、磋商的動(dòng)態(tài)過程,使得目標(biāo)國(guó)"保留權(quán)利"與外部介入之間得到恰當(dāng)界定與不斷調(diào)整。
[Abstract]:After the end of the Cold War, in order to protect the domestic people from serious human rights violations, on the basis of the existing international human rights law and humanitarian law, the international community began to gradually put forward and practice the concept and principle of the "responsibility to protect". However, even under the influence of the increasing international protection of human rights, the basic position of the principle of non-interference in internal affairs has not been fundamentally shaken. Therefore, the tension between the interpretation and application of the principle of non-interference in internal affairs and the international protection of human rights is becoming increasingly prominent. In the field of human rights protection, the international community should establish a dynamic flexible framework for the connotation, construction and interpretation of the principle of non-interference in internal affairs. Since the external intervention under the situation of "responsibility to protect" is a continuous and comprehensive method and process, the international community should form a dynamic process of dialogue, communication and consultation on the basis of the search and game of legitimate reasons and basis, so that the "reserved rights" of the target State and the external intervention can be properly defined and constantly adjusted.
