【摘要】：對(duì)中國(guó)周邊海洋劃界、航行、漁業(yè)資源養(yǎng)護(hù)與管理及海洋環(huán)境保護(hù)等問(wèn)題的學(xué)術(shù)探討中,1982年《聯(lián)合國(guó)海洋法公約》第九部分"閉�；虬腴]海"尚未得到充分的重視。通過(guò)結(jié)合《公約》第九部分的起草過(guò)程,其他國(guó)家針對(duì)閉�；虬腴]海的實(shí)踐,以及功能性區(qū)域合作法律的發(fā)展,本文認(rèn)為半閉�？勺鳛橹袊�(guó)應(yīng)對(duì)上述海洋問(wèn)題的出發(fā)點(diǎn)。本文結(jié)合南海的具體情況及既有實(shí)踐,以半閉海為出發(fā)點(diǎn),為中國(guó)在南海應(yīng)對(duì)劃界以及油氣資源開發(fā)、航行自由與安全、功能性區(qū)域合作等問(wèn)題提出相關(guān)建議。
[Abstract]:In the academic discussion on maritime delimitation, navigation, conservation and management of fishery resources and protection of marine environment around China, the ninth part of the 1982 United Nations Convention on the Law of the Sea, "closed Sea or semi-closed Sea", has not been paid enough attention to. Through the drafting process of part IX of the Convention, the practice of closed sea or semi-closed sea in other countries, and the development of functional regional cooperation law, this paper holds that semi-closed sea can be used as the starting point for China to deal with the above marine problems. Based on the specific situation and existing practice of the South China Sea and taking the semi-closed sea as the starting point, this paper puts forward some suggestions for China to deal with the delimitation of oil and gas resources, the development of oil and gas resources, the freedom and safety of navigation, and the functional regional cooperation in the South China Sea.
