論ICSID管轄權(quán)制度的變化趨勢

【摘要】:在國際投資領(lǐng)域特別是在私人國際投資領(lǐng)域,投資者與東道國之間因為投資而產(chǎn)生的各種爭端時有發(fā)生,這些爭端是否能得到及時、公正的解決,不但會影響投資者的直接利益,若處理不當(dāng)還可能會影響到投資者母國與東道國之間的經(jīng)濟關(guān)系。為了能夠及時、公正地解決私人國際投資爭端,世界銀行曾在上個世紀(jì)六十年代制定了《華盛頓公約》,根據(jù)這個公約,創(chuàng)立了“解決投資爭端國際中心”,也就是"ICSID"。因此,私人投資者就可以通過國際仲裁或調(diào)解程序解決其與東道國的投資爭端。雖然之后國際上又出現(xiàn)了一些其他的國際投資爭端解決機制,但大都是在ICSID確定的框架內(nèi),加入一些國際上有關(guān)國際投資與保護的新觀點。因此,進一步加深對ICSID管轄權(quán)制度的研究是符合我國經(jīng)濟發(fā)展趨勢的,對促進提高我國在國際經(jīng)濟發(fā)展中的地位和影響大有裨益。 根據(jù)對ICSID管轄權(quán)制度的闡述分析,結(jié)合國際經(jīng)濟社會的發(fā)展變化和我國的實際情況,并結(jié)合國際投資爭端解決機制的最新發(fā)展,對ICSID管轄權(quán)制度的具體變化進行深入的分析,文章主要運用歷史分析法和比較分析法,通過對ICSID管轄權(quán)問題的研究,使我們更清楚地了解和明確《華盛頓公約》及相關(guān)規(guī)則對ICSID管轄權(quán)的規(guī)定,以及它的變化,尤其是ICSID在裁斷投資案例時的態(tài)度及傾向,使我國在簽訂投資協(xié)定時有所借鑒。 全文共分五個部分:第一部分是對ICSID的歷史沿革進行全面的詳細(xì)的論述分析,這部分包括兩大內(nèi)容:一是產(chǎn)生的歷史背景的闡明;二是管轄權(quán)的主要內(nèi)容的理論;第二部分是對ICSID管轄權(quán)主體要件變化趨勢的探討,對ICSID管轄權(quán)主體要件的變化趨勢加以研究并進行思考,并引發(fā)對國際法結(jié)構(gòu)的反思;第三部分,對ICSID管轄權(quán)客體要件的變化趨勢進行了系統(tǒng)地論述;第四部分,對CSID管轄權(quán)的發(fā)展動向和改善舉措做了較為深入地分析;第五部分,對ICSID管轄權(quán)的變化對中國的影響以及在ICSID管轄權(quán)擴大化的新形式下我國所做的應(yīng)對措施作詳細(xì)的論述,借此維護我國在國際經(jīng)濟交往中的利益。 經(jīng)過深入的研究,得出以下結(jié)論:第一,從ICSID管轄權(quán)成立以來,ICSID管轄權(quán)主體從嚴(yán)格限制走向?qū)捤。第?《華盛頓公約》中未作出的“投資”定義范圍已經(jīng)發(fā)生了潛移默化的擴大。第三,ICSID管轄權(quán)的改革需要穩(wěn)步推進,面對ICSID管轄權(quán)問題,要有所進退。對于爭議是否應(yīng)該交付ICSID解決,這個問題應(yīng)該區(qū)別對待,需要在實際的模式當(dāng)中進行總結(jié)。但是,我們應(yīng)該清楚地認(rèn)識到,一些爭議不應(yīng)該納入中心管轄范圍:比如對我國法律法規(guī)適用引起的爭議等。。其中關(guān)于ICSID管轄權(quán)主體、客體變化趨勢的研究是本課題的一大亮點,此外在ICSID管轄權(quán)改善舉措上的探索也是本文的創(chuàng)新之處,通過對ICSID管轄權(quán)變化趨勢的研究,能促進更為合理的國際投資制度的建設(shè)。
[Abstract]:In the field of international investment, especially in the field of private international investment, various disputes between investors and host countries arising from investment occur from time to time. Whether these disputes can be settled in a timely and just manner will not only affect the direct interests of investors, but also affect the economic relations between the home country of investors and the host country if handled improperly. In order to resolve private international investment disputes in a timely and just manner, the World Bank formulated the Washington Convention in the 1960s, according to which the International Center for the settlement of Investment disputes, or ICSID, was created. As a result, private investors can resolve their investment disputes with host countries through international arbitration or mediation procedures. Although some other international investment dispute settlement mechanisms have emerged in the world since then, most of them have added some new international views on international investment and protection within the framework determined by ICSID. Therefore, further deepening the study of ICSID jurisdiction system is in line with the trend of economic development in China, and is of great benefit to the promotion and improvement of China's position and influence in the development of international economy. According to the exposition and analysis of ICSID jurisdiction system, combined with the development and change of international economy and society and the actual situation of our country, and combined with the latest development of international investment dispute settlement mechanism, this paper makes a deep analysis of the specific changes of ICSID jurisdiction system. This paper mainly uses historical analysis and comparative analysis to study the jurisdiction of ICSID. It makes us more clearly understand and clarify the provisions of the Washington Convention and related rules on the jurisdiction of ICSID, as well as its changes, especially the attitude and tendency of ICSID in determining investment cases, so that our country can draw lessons from the signing of investment agreements. The full text is divided into five parts: the first part is a comprehensive and detailed discussion and analysis of the historical evolution of ICSID, which includes two main contents: one is the clarification of the historical background; the other is the theory of the main content of jurisdiction; the second part is the discussion of the changing trend of the main elements of ICSID jurisdiction, the study and reflection on the changing trend of the main elements of ICSID jurisdiction, and the reflection on the structure of international law. The third part systematically discusses the changing trend of the object elements of ICSID jurisdiction; the fourth part makes a more in-depth analysis of the development trend and improvement measures of CSID jurisdiction; the fifth part discusses in detail the influence of the change of ICSID jurisdiction on China and the countermeasures made by China under the new form of the expansion of ICSID jurisdiction, so as to safeguard China's interests in international economic exchanges. After in-depth study, the following conclusions are drawn: first, since the establishment of ICSID jurisdiction, the subject of ICSID jurisdiction has changed from strict restriction to easing. Second, the scope of the definition of "investment" not made in the Washington Convention has been expanded imperceptibly. Third, the reform of ICSID jurisdiction needs to be steadily advanced, in the face of ICSID jurisdiction, we should advance and retreat. Whether the dispute should be delivered to ICSID for resolution should be treated differently and needs to be summarized in the actual model. However, we should clearly realize that some disputes should not be included in the central jurisdiction: for example, disputes arising from the application of laws and regulations in our country. Among them, the research on the changing trend of the subject and object of ICSID jurisdiction is a bright spot of this topic. In addition, the exploration on the improvement measures of ICSID jurisdiction is also the innovation of this paper. Through the study of the changing trend of ICSID jurisdiction, it can promote the construction of a more reasonable international investment system.
