反傾銷法中公共利益原則研究

【摘要】:隨著國(guó)際貿(mào)易的發(fā)展和繁榮,各國(guó)關(guān)稅政策的不斷調(diào)整,反傾銷措施的使用頻率越來(lái)越高,反傾銷案件近幾年來(lái)也逐漸增多,并有上升的趨勢(shì)。如此多的反傾銷案件,不乏有濫用反傾銷措施的案件,就目前來(lái)看,濫用反傾銷措施案件所占的比例不少,顯然反傾銷措施已經(jīng)成為個(gè)別國(guó)家進(jìn)行貿(mào)易保護(hù)的工具。如何使反傾銷法充分發(fā)揮維護(hù)公平貿(mào)易的作用,世界各國(guó)開(kāi)始關(guān)注這一問(wèn)題。在當(dāng)前國(guó)際貿(mào)易背景下,在反傾銷法中規(guī)定公共利益原則是解決此問(wèn)題關(guān)鍵,或者說(shuō)是一種有效的方法。在反傾銷法中規(guī)定公共利益原則的國(guó)家不多,因此,一些公共利益原則的相關(guān)問(wèn)題規(guī)定的還不明確,有待于進(jìn)一步完善。 本文旨在通過(guò)對(duì)WTO、歐盟、加拿大、美國(guó)有關(guān)反傾銷法公共利益原則的相關(guān)規(guī)定進(jìn)行分析和論述的基礎(chǔ)上,對(duì)我國(guó)反傾銷法如何對(duì)公共利益原則進(jìn)行規(guī)定提出了一些意見(jiàn)和建議。 本文共四部分,第一章是論文的基礎(chǔ),第一節(jié)介紹了傾銷和反傾銷法,第二節(jié)提出了公共利益應(yīng)當(dāng)具備的因素,第三節(jié)論述了在反傾銷法中規(guī)定公共利益原則的必要性。第二章利用列舉的方法論述了反傾銷法中公共利益原則的標(biāo)準(zhǔn)。第三章和第四章都利用對(duì)比分析的方法,在分析WTO、歐盟、加拿大、美國(guó)相關(guān)規(guī)定的基礎(chǔ)上,分別對(duì)公共利益審查利害關(guān)系人和公共利益審查程序提出一些建議和意見(jiàn)。 最后的結(jié)論為,一、公共利益原則在反傾銷法中必不可少。二、明確公共利益原則的確定因素以更好的實(shí)現(xiàn)反傾銷法中公共利益原則存在的價(jià)值。三、反傾銷法公共利益原則審查利害關(guān)系人范圍為:國(guó)內(nèi)生產(chǎn)商、進(jìn)口商、工業(yè)用戶、消費(fèi)者及消費(fèi)者組織。公共利益審查的具體程序?yàn)椋菏紫?由有權(quán)方提出公共利益調(diào)查申請(qǐng),其次,利害關(guān)系人按規(guī)定在一定期限內(nèi)提交相關(guān)文件和材料,再次,由主管機(jī)關(guān)作出是否進(jìn)行公共利益調(diào)查的決定,如果決定啟動(dòng)公共利益調(diào)查程序,那么接著按規(guī)定舉行聽(tīng)證會(huì),然后由主管機(jī)關(guān)作出最后裁判。
[Abstract]:With the development and prosperity of international trade and the continuous adjustment of tariff policies in various countries, the frequency of use of anti-dumping measures is getting higher and higher, and anti-dumping cases have gradually increased in recent years, and there is an upward trend. There are so many anti-dumping cases, there are many cases of abuse of anti-dumping measures. At present, the proportion of cases of abuse of anti-dumping measures is quite a lot. Obviously, anti-dumping measures have become a tool for individual countries to carry out trade protection. How to make the anti-dumping law give full play to the role of maintaining fair trade, countries all over the world began to pay attention to this problem. In the context of current international trade, the principle of public interest in anti-dumping law is the key to solve this problem, or an effective method. There are not many countries that stipulate the principle of public interest in the anti-dumping law, therefore, some related issues of the principle of public interest are not clear and need to be further improved. Based on the analysis and discussion of the relevant provisions of WTO, EU, Canada and the United States on the principle of public interest in anti-dumping law, this paper puts forward some suggestions and suggestions on how to regulate the principle of public interest in China's anti-dumping law. This paper consists of four parts, the first chapter is the basis of the paper, the first section introduces the dumping and anti-dumping law, the second section puts forward the factors that the public interest should have, and the third section discusses the necessity of prescribing the principle of the public interest in the anti-dumping law. The second chapter discusses the standard of public interest principle in anti-dumping law by enumerating methods. The third chapter and the fourth chapter use the method of comparative analysis, on the basis of analyzing the relevant provisions of WTO, EU, Canada and the United States, respectively, put forward some suggestions and opinions on the public interest review stakeholders and the public interest review procedure. The final conclusion is that, first, the principle of public interest is essential in anti-dumping law. Second, make clear the determining factors of the principle of public interest in order to better realize the value of the principle of public interest in anti-dumping law. Third, the scope of the review of public interest principles of anti-dumping law is: domestic manufacturers, importers, industrial users, consumers and consumer organizations. The specific procedures of public interest review are as follows: first, the competent party shall submit the application for public interest investigation, secondly, the interested party shall submit the relevant documents and materials within a certain time limit according to the prescribed time limit, and again, the competent authority shall make a decision on whether to conduct the public interest investigation. If it decides to initiate the public interest investigation procedure, then a hearing shall be held in accordance with the relevant provisions, and then the competent authority shall make a final decision.
