【摘要】：外空法對外空軍事化這一概念沒有明確界定,因此國際社會對外空軍事化存在不同的解讀,并形成了相應(yīng)的法律學(xué)說。禁止外空軍事化說認(rèn)為,人類利用外空應(yīng)出于和平目的,而一切形式的外空軍事化都是與和平目的相違背的。允許外空軍事化學(xué)說認(rèn)為不僅被動的外空軍事化是正當(dāng)?shù)?而且主動的外空武器化也是正當(dāng)?shù)�。部分禁止外空軍事化學(xué)說則反對毫無限制的外空武器化,但認(rèn)可在一定范圍內(nèi)的外空軍事化利用。第一種學(xué)說過于理想主義而且與現(xiàn)行法律并不相符;第二種學(xué)說是霸權(quán)主義和冒險主義的體現(xiàn),將導(dǎo)致外空軍備競賽,并可能帶來眾多惡果;第三種觀點更趨現(xiàn)實主義,但需要凝聚共識,以構(gòu)筑可操作的法律機制。面對由安全困境所導(dǎo)致的軍備競賽的可能性,必須通過國際法來緩解困境,尋求外層空間的共同安全。
[Abstract]:The concept of outer space militarization is not clearly defined in outer space law, so the international community has different interpretations of outer space militarization and forms the corresponding legal doctrine. The theory of banning the militarization of outer space holds that the use of outer space by mankind should be for peaceful purposes, and all forms of militarization of outer space are contrary to peaceful purposes. The doctrine of allowing the militarization of outer space is justified not only by passive militarization of outer space, but also by active weaponization of outer space. Part of the theory of banning the militarization of outer space opposes the weaponization of outer space without restriction, but accepts the militarization of outer space to a certain extent. The first doctrine is too idealistic and inconsistent with existing laws; the second is a manifestation of hegemonism and adventurism, which will lead to an arms race in outer space and may have many adverse consequences; The third view is more realistic, but requires consensus to build an operational legal mechanism. In the face of the possibility of an arms race caused by security dilemmas, the dilemma must be alleviated through international law and the common security of outer space must be pursued.
