【摘要】：2009年12月1日生效的《里斯本條約》將對(duì)歐盟對(duì)外貿(mào)易法律制度產(chǎn)生深遠(yuǎn)的影響,具體體現(xiàn)在以下幾個(gè)方面:第一,明確規(guī)定了歐盟的法律人格,確立了歐盟對(duì)外貿(mào)易的主體資格;第二,明確規(guī)定了歐盟共同商業(yè)政策的專(zhuān)屬性;第三,擴(kuò)大歐盟對(duì)外貿(mào)易主體的法律權(quán)能;第四,提高了歐盟理事會(huì)共同商業(yè)政策的決策效率;第五,提高議會(huì)在共同商業(yè)政策中的作用;第六,確保歐盟共同商業(yè)政策與歐盟其他對(duì)外關(guān)系的一致性。本文作者對(duì)此問(wèn)題逐一進(jìn)行闡述,對(duì)我們深入理解《里斯本條約》的內(nèi)涵實(shí)質(zhì)具有很好的指導(dǎo)意義。
[Abstract]:The Lisbon Treaty, which entered into force on December 1, 2009, will have a profound impact on the EU's foreign trade legal system, which is embodied in the following aspects: first, it clearly stipulates the legal personality of the EU. The subject qualification of EU foreign trade has been established. Secondly, it clearly stipulates the specificity of the EU Common Business Policy; thirdly, it expands the legal competence of the EU foreign trade subjects; fourthly, it improves the efficiency of the EU Council's decision on the Common Business Policy. Fifth, to enhance the role of parliament in the common business policy; sixth, to ensure the consistency of the EU common business policy with other EU external relations. The author expounds this problem one by one, which has a good guiding significance for us to understand the essence of Lisbon Treaty.
