【摘要】：第五管轄權(quán)是作為調(diào)整國(guó)際航空運(yùn)輸某些規(guī)則的1999年《蒙特利爾公約》對(duì)華沙公約體系進(jìn)行現(xiàn)代化和一體化過(guò)程中的創(chuàng)新因素之一,其功能在于能夠更加全面、公平地維護(hù)航空旅客運(yùn)輸消費(fèi)者的合法權(quán)益,以體現(xiàn)該公約制定的宗旨和原則。借鑒第五管轄權(quán)的創(chuàng)新性規(guī)定及對(duì)消費(fèi)者權(quán)益保護(hù)的特有屬性,我國(guó)在未來(lái)修訂《民用航空法》時(shí)亦應(yīng)適時(shí)加入相應(yīng)條款。
[Abstract]:The fifth jurisdiction is one of the innovative elements in the modernization and integration of the Warsaw Convention system under the 1999 Montreal Convention, which regulates certain rules governing international air transport, and its function is to make it more comprehensive, To protect the legitimate rights and interests of air passenger transport consumers fairly, to reflect the purpose and principles of the Convention. With reference to the innovative provisions of the Fifth jurisdiction and the special attributes of the protection of the rights and interests of consumers, China should also include relevant clauses in the future revision of Civil Aviation Law.
