從納粹掠奪藝術品的返還看日掠文物返還可行性

【摘要】：第二次世界大戰(zhàn)中被掠奪或被非法轉移文物的返還至今還是一個特殊的歷史遺留問題。經過幾十年的努力,納粹掠奪藝術品必須返還給受害者已經成為一種國際共識,歐美各國通過締結雙邊或多邊協(xié)定、制定特別立法、建立專門機構以及司法救濟等方式,促成許多被掠藝術品返還給原所有人或合法繼承者�？谷諔�(zhàn)爭是第二次世界大戰(zhàn)的有機組成部分,日本掠奪文物與納粹掠奪藝術品的做法如出一轍,國際社會在處理因納粹掠奪藝術品帶來的國際爭端方面積累的實踐和經驗,對于亞洲國家處理被日掠奪文物的返還也具有較強的借鑒意義。
[Abstract]:The return of cultural relics looted or illegally transferred in World War II is still a special historical issue. After decades of efforts, it has become an international consensus that the Nazi plundered works of art must be returned to the victims. Countries in Europe and the United States have concluded bilateral or multilateral agreements, formulated special legislation, established specialized agencies, and established judicial remedies. Facilitating the return of many looted works of art to their original owners or legal successors. The War of Resistance against Japan is an integral part of the second World War, and Japan's plundering of cultural relics is the same as the Nazi's practice of pillaging works of art. The international community has accumulated practice and experience in dealing with international disputes arising from Nazi pillaging of works of art. Asian countries also have a strong reference for handling the return of cultural relics plundered by Japan.
