【摘要】：20世紀(jì)各國(guó)沖突規(guī)范的靈活性在不同程度上、以不同速度得以提升,但其始終沒有完全取代沖突規(guī)范中的確定性。經(jīng)濟(jì)學(xué)分析能夠?qū)_突規(guī)范的這種發(fā)展趨勢(shì)提供合理的分析與解釋,并在沖突規(guī)范的靈活性與確定性之間做出選擇。沖突規(guī)范選擇靈活性和確定性的不同條件在經(jīng)濟(jì)學(xué)的視域內(nèi)可以清晰呈現(xiàn)。增加沖突規(guī)范的靈活性、擴(kuò)大法律選擇的主體和可供選擇的法律的范圍能夠營(yíng)造競(jìng)爭(zhēng)性的法律選擇市場(chǎng),實(shí)現(xiàn)對(duì)法律選擇權(quán)利的有效配置;而保持沖突規(guī)范的確定性,對(duì)于實(shí)現(xiàn)特定政策以及提高相關(guān)資源配置的效率所具有的作用也是不容忽視的。經(jīng)濟(jì)學(xué)分析提供的分析方法和效率觀念所選擇的沖突規(guī)范發(fā)展趨勢(shì)已經(jīng)越來越多地體現(xiàn)在各國(guó)沖突規(guī)范中。
[Abstract]:In the 20th century, the flexibility of conflict norms was improved in different degrees and at different speeds, but it never completely replaced the certainty of conflict norms. Economic analysis can provide reasonable analysis and explanation for the development trend of conflict norms and make a choice between flexibility and certainty of conflict norms. The different conditions of flexibility and certainty in the choice of conflict norms can be clearly presented from the perspective of economics. Increasing the flexibility of conflict norms, expanding the subject of legal choice and the scope of alternative law can create a competitive market for legal choice and realize the effective allocation of the right of legal choice; It is also important to maintain the certainty of conflict rules to realize specific policies and to improve the efficiency of resource allocation. The tendency of conflict norms chosen by the analytical methods and efficiency concepts provided by economic analysis has been more and more reflected in the conflict norms of various countries.
