【摘要】：《聯(lián)合國海洋法公約》的實施改變了傳統(tǒng)的海洋漁業(yè)秩序和資源分配格局，圍繞海洋資源，特別是公海生物資源的爭奪，已經成為新時期海洋斗爭的重要特點。由于全球近海漁業(yè)資源已經處于過度開發(fā)狀態(tài)，海洋生物資源衰竭的速度超乎人們的想象，大大降低了公海生物資源可持續(xù)利用水平和未來利用價值。全球漁業(yè)普遍面臨著過度投資、種群枯竭、漁獲量下降和資源利用沖突加劇等問題，世界進入了爭奪公海漁業(yè)資源的時代。但是關于公海漁業(yè)資源，到目前為止仍然缺乏全面的、強制性的管理制度。對于公海海洋生物資源養(yǎng)護和管理的理論和實踐研究，在國際和國內都是學術界的熱點問題。 本論文共分9章，第一章是緒論，第九章是結語。第二章是公海及海洋生物資源傳統(tǒng)管理理論的發(fā)展，簡要評述了西方中世紀前的有關理論和中國“以陸治�！焙汀耙院樘铩钡霓r耕海洋觀、格老秀斯的海洋自由論、塞爾登的閉海論和賓刻舒克的海洋領有論，這些理論體現(xiàn)了現(xiàn)代海洋理論的思想源泉；并著重對近現(xiàn)代海洋思想產生重大影響的馬漢的海權論進行了評析。第三章是《聯(lián)合國海洋法公約》有關制度及其影響。論述了公海捕魚舊制度的危機，從第二次世界大戰(zhàn)后科技進步促進了海洋捕撈能力的提升，公海自由無序捕撈造成的海洋生物資源的破壞和衰退；到沿海國試圖瓜分公海，紛紛對毗鄰海域提出主權要求；簡要介紹了《聯(lián)合國海洋法公約》的基本內容，，重點對《公約》中影響海洋生物資源管理的幾個重要原則和制度，如至關重要的專屬經濟區(qū)制度做了介紹，分析了《公約》對公海漁業(yè)制度和國際海洋生物資源管理和養(yǎng)護制度的深遠影響。分析了《公約》引發(fā)的海洋觀變革，促進了對海洋生物資源認識的根本轉變。第四章是公海生物資源管理制度的實踐探索，該章重點研究了《公約》實施后，對建立新的公海生物資源養(yǎng)護管理制度產生重大影響的《促進公海漁船遵守國際養(yǎng)護和管理措施的協(xié)定》、《負責任漁業(yè)行為守則》、《執(zhí)行協(xié)定》、《國際打擊IUU行動計劃》和聯(lián)合國關于禁止公海流刺網的決議。第五章是公海生物資源管理制度的基本原則，該章開創(chuàng)性地總結了建立公海生物資源管理養(yǎng)護制度的五項基本原則，即共同繼承財產與整體性原則、權利平等與合作原則、科學養(yǎng)護與合理利用原則、可持續(xù)發(fā)展與有序性原則和以人為本與生態(tài)系統(tǒng)原則，這五項基本原則的確立是徹底解決當前公海海洋生物資源存在問題的思想基礎，是建立公海生物資源養(yǎng)護和管理制度的核心原則。第六章是公海生物資源管理制度構架研究，《公約》實施后，雖然探索建立了一些國際海洋生物養(yǎng)護管理制度，但世界上仍然缺乏統(tǒng)一的、普遍認同和遵守的、涵蓋所有海洋生物資源的管理制度。世界迫切需要在國際共管海域——公海上建立海洋生物資源管理制度。該章通過分析當前公海漁業(yè)資源管理的實踐與存在的問題，探討建立國際海洋生物資源管理組織的可行性，提出了建立國際海洋生物資源管理組織可行的基本構架。第七章是公海生物資源管理制度的執(zhí)行措施和程序保障，該章總結了《公約》實施后公海漁業(yè)創(chuàng)立的主要管理措施，重點評介了沿海國管轄權的持續(xù)擴大、港口國措施、IUU條例中的程序規(guī)定和具體措施以及輸歐海洋捕撈產品的有關規(guī)定，就公海漁業(yè)管理基本程序的幾個重要問題進行了分析。強調訂立新的、以《聯(lián)合國海洋法公約》為基礎的“公海生物資源管理與養(yǎng)護公約”，并參照WTO爭端解決機制在程序上保障新公約的權威性、強制性和可執(zhí)行性，是徹底解決當前公海生物資源管理與養(yǎng)護中棘手問題的切實可行的辦法。第八章是公海生物資源管理制度的發(fā)展及應對建議，該章提出，國際漁業(yè)法律制度的發(fā)展正在有力地推動公海漁業(yè)管理的國際化趨勢；公海漁業(yè)管理措施更加趨向于強制性，對公海漁業(yè)的綜合管理是發(fā)展的必然；區(qū)域性漁業(yè)管理不斷加強，催生國際漁業(yè)管理實體組織誕生，公海漁業(yè)管理制度已隱然成型；公海漁業(yè)已進入全面嚴格管理時代。同時也對我國應如何積極、妥善應對國際海洋法律制度變革帶來的挑戰(zhàn)，提出了一些政策建議。 本論文圍繞公海生物資源管理制度問題，梳理評述了中外關于漁業(yè)資源管理理論的主要觀點，并主要在以下幾個方面進行了創(chuàng)新性探討：首次提出建立新的國際漁業(yè)管理組織應當遵循的基本原則；嘗試給即將誕生的國際漁業(yè)管理組織搭建一個科學可行的框架；對保障國際漁業(yè)管理組織得以正常運轉的程序和執(zhí)行制度進行了研究分析；為我國公海漁業(yè)的發(fā)展提出一些政策建議，對公海生物資源管理制度今后的發(fā)展方向進行了研究和判斷。
[Abstract]:The implementation of the United Nations Convention on the Law of the Sea has changed the pattern of traditional international order and resource allocation, and has become an important feature of the ocean struggle in the new period around the scramble for marine resources, especially the high seas biological resources. Due to the overexploitation of the global near-sea fishery resources, the velocity of marine biological resource exhaustion is beyond the imagination of people, thus greatly reducing the sustainable utilization level and the future utilization value of the biological resources of the high seas. Global fisheries generally face problems such as over-investment, depletion of stocks, declining catch and increased use of resources, and the world has entered an era for the high seas fishery resources. However, with regard to the high seas fishery resources, there is still a lack of comprehensive and mandatory management systems. The research on the theory and practice of conservation and management of marine biological resources in the high seas is a hot issue in the academia at both the international and the national level. This thesis is divided into 9 chapters, the first chapter is the introduction, and Chapter 9 is the introduction. The second chapter is the development of the traditional management theory of the high seas and marine life resources, and briefly reviews the relevant theories in the western Middle Ages. and China "Taking Land cure Sea and Sea These theories embody the source of thought of modern ocean theory, and focus on the sea rights theory of Mahan, which has a great influence on modern ocean thought.
