【摘要】：國際法學(xué)界對于科索沃問題的研究歷來頗具爭議，，以最新出臺的科索沃國際法院咨詢意見為研究主體對這一問題的再度研究具有重要的理論意義。國際法院就科索沃問題公布的咨詢意見雖然沒有強制力，但是其影響力卻是巨大的，它有可能打破現(xiàn)今國際社會穩(wěn)定的格局，影響和諧的國際秩序，對于這一問題的研究更具有現(xiàn)實意義。本文將采用理論分析法、規(guī)范分析法、對比分析法和例證法相結(jié)合的綜合分析法進行研究。 本文主要將以最新發(fā)布的科索沃獨立國際法院咨詢意見為背景，分析國際法院咨詢意見的背景、特征，著重對國際法院咨詢意見涉及到的程序和實體問題進行研究。國際法院咨詢意見雖然沒有強制力，但是卻有極大的影響力，它的價值在于為聯(lián)合國提供參考性建議。咨詢意見發(fā)布后，它也成為各國分裂勢力的風(fēng)向標，它所產(chǎn)生的消極影響遠遠大于它的積極影響，透過科索沃獨立國際法院咨詢意見的剖析來反思科索沃要想獨立成為一個國家需要滿足的條件，反思國際法院咨詢意見到底違反了那些國際法原理。從研究成果上看，科索沃獨立必須滿足國家構(gòu)成的要件，需要符合聯(lián)合國決議的法律效力，還應(yīng)該對民族自決權(quán)合法、適當(dāng)?shù)倪\用。雖然國際法院宣布科索沃單方面宣布獨立沒有違反國際法的相關(guān)規(guī)定，但并不能就些認為其獨立是成立的。 本篇文章希望借助對科索沃國際法院咨詢意見的解讀和對理論的研究，提出科索沃獨立不合法的國際法理論依據(jù)，對存在類似分離勢力和活動的國家給予法律上的警示和根據(jù)，履行一名法律人的社會使命和責(zé)任。
[Abstract]:The research on Kosovo has always been controversial in the field of international law. It is of great theoretical significance to take the advisory opinion of the International Court of Justice of Kosovo as the research subject. The advisory opinion issued by the International Court of Justice on the question of Kosovo, although not coercive, has enormous influence and is likely to break the present pattern of stability in the international community and affect a harmonious international order, The study of this problem has more practical significance. In this paper, a comprehensive analysis method combining theoretical analysis, normative analysis, comparative analysis and illustrative analysis is adopted. Based on the newly issued advisory opinion of the International Court of Justice in Kosovo, this paper will analyze the background and characteristics of the advisory opinion of the International Court of Justice, focusing on the procedural and substantive issues involved in the advisory opinion of the International Court of Justice. The advisory opinion of the International Court of Justice, although not coercive, has great influence, and its value lies in providing the United Nations with reference advice. After the advisory opinion was issued, it also became a bellwether of separatist forces in various countries, and its negative impact was far greater than its positive impact. Through the analysis of the advisory opinion of the Independent International Court of Justice in Kosovo, this paper reflects on the conditions that Kosovo needs to satisfy if it wants to become an independent state, and reflects on the principles of international law that the advisory opinion of the International Court of Justice has violated. From the point of view of the research results, the independence of Kosovo must meet the requirements of the constitution of the state, the legal effect of the UN resolutions, and the legitimate and proper application of the right of national self-determination. Although the declaration by the International Court of Justice of Kosovo's unilateral declaration of independence does not violate the relevant provisions of international law, it cannot be regarded as valid. This article hopes that with the help of the interpretation of the advisory opinion of the International Court of Justice in Kosovo and the study of theory, this article will put forward the theoretical basis of international law for Kosovo's independence and illegality, and give legal warnings and bases to countries with similar separatist forces and activities. Fulfill the social mission and responsibility of a legal person.
