【摘要】：在網(wǎng)絡(luò)安全問題日益嚴峻的今天,國家在遭受網(wǎng)絡(luò)攻擊時自衛(wèi)權(quán)的行使成為事關(guān)國家安全的重要問題。有鑒于此,北約卓越合作網(wǎng)絡(luò)防御中心在2013年發(fā)布的《塔林手冊》中,就這一問題進行了專門研究。《塔林手冊》以傳統(tǒng)國際法理論為依據(jù),并結(jié)合互聯(lián)網(wǎng)的技術(shù)特性,對網(wǎng)絡(luò)攻擊中自衛(wèi)權(quán)的行使提出了一個概括性的法律框架,同時也對其中的爭議問題進行了探討和解釋。整體來看,《塔林手冊》對于這一問題的研究固然不乏可取之處,卻也存有一系列問題。無論如何,《塔林手冊》作為當(dāng)今國際社會第一部全面分析網(wǎng)絡(luò)攻擊中的國際法規(guī)范的研究成果,其中關(guān)于網(wǎng)絡(luò)自衛(wèi)權(quán)的規(guī)范和解釋,值得我們進一步的分析和探討。
[Abstract]:Nowadays, the problem of network security is becoming more and more serious, and the exercise of the right of self-defense becomes an important issue concerning the national security when the country is attacked by the network. In view of this, the NATO Center for Network Defense for Excellence and Cooperation conducted a special study on this issue in the Tallinn Manual, released in 2013. The Tallinn Manual is based on traditional theories of international law and combines the technical characteristics of the Internet. This paper puts forward a general legal framework for the exercise of the right of self-defense in the network attack, and also discusses and explains the controversial issues in it. As a whole, the Tallinn Manual has some merits, but there are also a series of problems. In any case, the Tallinn Manual, as the first comprehensive analysis of the international law norms in cyberattacks, is worthy of further analysis and discussion.
