【摘要】：當(dāng)今世界環(huán)境學(xué)科領(lǐng)域存在著具有廣泛影響的"后代人權(quán)利"理論。但后代人權(quán)利論者用以支持后代人權(quán)利的各種證據(jù)都無法在邏輯上必然推出后代人享有權(quán)利的結(jié)論。后代人權(quán)利理論賴以成立的預(yù)設(shè)性前提也是虛構(gòu)的客觀事實。雖然近代以來,傳統(tǒng)權(quán)利的主體范圍確實有所擴展,但這種擴展并非是隨意的。權(quán)利不可能擴展到后代人權(quán)利論者所說的"后代人"身上。環(huán)境義務(wù)是后代人權(quán)利理論的本質(zhì),也是后代人權(quán)利理論的正確出路和歸宿。
[Abstract]:In the field of environmental science in the world today, there is a theory of "the rights of future generations" which has extensive influence. However, all kinds of evidences used by descendant rights theorists to support the rights of future generations cannot logically infer the conclusion that the later generations have rights. The presupposition premise on which the theory of human rights is established is also a fictional objective fact. Although the scope of the subject of traditional rights has been expanded since modern times, this expansion is not random. Rights cannot be extended to future generations, as the rights theorists call them. Environmental obligation is the essence of the theory of human rights of future generations, and the correct way and destination of the theory of human rights of future generations.
