【摘要】：正知識產(chǎn)權爭端已成為影響我國對外貿(mào)易發(fā)展的重要因素之一。中美知識產(chǎn)權爭端的應對將是一場持久戰(zhàn)。應對中美知識產(chǎn)權爭端,是中國從貿(mào)易大國向貿(mào)易強國轉變過程中的必修課。一、中國企業(yè)在美國遭遇知識產(chǎn)權爭端情況評析中國企業(yè)在美國遭遇知識產(chǎn)權爭端由來已久,2001年年末中國加入WTO之后,"301條款"的有效性逐漸弱化,"337條款"成為美國針對中國企業(yè)提起知識產(chǎn)權爭端的主打工具。中國企業(yè)在美國遭遇知識
[Abstract]:Intellectual property disputes have become one of the important factors affecting the development of China's foreign trade. The handling of Sino-US intellectual property disputes will be a protracted war. The handling of Sino-US intellectual property disputes is a compulsory course in the process of China's transformation from a trading power to a trading power. Chinese enterprises have been confronted with intellectual property disputes in the United States for a long time. After China joined the WTO at the end of 2001, the validity of "301 clause" has gradually weakened, and "337 clause" has become the main tool for the United States to initiate intellectual property disputes against Chinese enterprises.
