【摘要】：英國(guó)自17世紀(jì)開始承認(rèn)和執(zhí)行外國(guó)法院判決以來,在承認(rèn)和執(zhí)行外國(guó)判決的理論依據(jù)方面先后經(jīng)歷了"禮讓說"、"債務(wù)論"等理論,1907年的艾默紐爾訴希芒案(Emanuel v.Symon)所確立的五條規(guī)則,基本上是英國(guó)法院承認(rèn)和執(zhí)行外國(guó)對(duì)人訴訟判決的基本規(guī)則。但1953年特華斯訴浩利案(Travers v.Holly)的判決,使得英國(guó)上訴法院開始考慮司法禮讓問題;加拿大在1990年的莫哥德投資有限公司(Morguard Investments Ltd.v.De Savoye)案之前,一直遵循希芒案規(guī)則。但莫哥德投資公司案判例所包含的司法禮讓規(guī)則,豐富了加拿大國(guó)際私法的"就近原則"。莫哥德投資公司案由此成為加拿大各姊妹省相互間承認(rèn)和執(zhí)行法院判決具有里程碑意義的判例。英國(guó)及加拿大的理論與實(shí)踐,對(duì)解決我國(guó)各法域間民商事判決的相互承認(rèn)與執(zhí)行問題,無疑具有重要借鑒意義。
[Abstract]:Since Britain began to recognize and enforce foreign court decisions in the 17th century, In the theoretical basis of the recognition and enforcement of foreign judgments, it has experienced the theory of "comity" and "debt theory" successively, and the five rules established in the case of Emmanuel v. Simao (Emanuel v.Symon) in 1907. It is basically the basic rule for the English courts to recognize and enforce foreign judgments in action in personae. But the 1953 decision in Twains v. Travers v.Holly led the British Court of Appeal to consider the issue of judicial comity, while Canada followed the Simao rule until the 1990 (Morguard Investments Ltd.v.De Savoye case. However, the judicial comity rule contained in the case of Mogoth Investment Corporation enriches the "proximity principle" of Canadian private international law. The Mogode Investment case has thus become a landmark case in the recognition and enforcement of court decisions among the sister provinces of Canada. The theory and practice of Britain and Canada are undoubtedly of great significance for solving the problems of mutual recognition and enforcement of civil and commercial judgments in various jurisdictions of our country.
