【摘要】：隨經(jīng)貿(mào)領(lǐng)域國(guó)際爭(zhēng)端發(fā)生概率的日益提高,國(guó)際爭(zhēng)端解決機(jī)制已經(jīng)成為不可或缺的國(guó)際協(xié)調(diào)制度,成為許多國(guó)際協(xié)定的必備條款。世界貿(mào)易組織(以下簡(jiǎn)稱“WTO”)作為世界上最大的經(jīng)濟(jì)組織,其爭(zhēng)端解決機(jī)制因特色之鮮明,涉及領(lǐng)域之廣泛,解決糾紛的數(shù)量之龐大而備受關(guān)注。TPP協(xié)定的面世推動(dòng)了全球經(jīng)貿(mào)規(guī)則的新一輪博弈,在爭(zhēng)端解決領(lǐng)域,新生的TPP常規(guī)爭(zhēng)端解決機(jī)制實(shí)現(xiàn)了若干突破與創(chuàng)新,它們既彌合了現(xiàn)行WTO爭(zhēng)端解決機(jī)制的不足,也推動(dòng)了當(dāng)前區(qū)域貿(mào)易爭(zhēng)端解決機(jī)制的縱深發(fā)展,更為當(dāng)下中國(guó)方興未艾的自貿(mào)區(qū)建設(shè)提供了有益借鑒。本文擬對(duì)TPP爭(zhēng)端解決機(jī)制與WTO框架下爭(zhēng)端解決規(guī)則進(jìn)行法律解析、對(duì)比研究,以把握國(guó)際爭(zhēng)端解決機(jī)制最新發(fā)展動(dòng)態(tài)及其對(duì)未來(lái)國(guó)際貿(mào)易規(guī)則體系的長(zhǎng)遠(yuǎn)影響。國(guó)際投資協(xié)定中的投資者—東道國(guó)爭(zhēng)端解決(ISDS)機(jī)制成為當(dāng)代投資協(xié)定中不可或缺的組成部分,但其自身也存在著一些制度性與技術(shù)性缺陷,在處理投資爭(zhēng)端問(wèn)題中引起各國(guó)的廣泛關(guān)注。分析與研究ISDS機(jī)制有助于中國(guó)在雙邊投資協(xié)定談判中保護(hù)本國(guó)的經(jīng)濟(jì)利益,并增強(qiáng)中國(guó)在制訂國(guó)際投資新規(guī)則領(lǐng)域的話語(yǔ)權(quán)。第一章概述WTO、TPP及NAFTA的爭(zhēng)端解決機(jī)制;第二章、第三章及第四章從爭(zhēng)端解決機(jī)制的主體、程序、執(zhí)行措施三方面詳細(xì)闡述WTO及TPP爭(zhēng)端解決機(jī)制的不同之處并分析TPP對(duì)WTO的沖擊;第五章分析TPP對(duì)國(guó)際貿(mào)易規(guī)則發(fā)展的長(zhǎng)遠(yuǎn)影響以及中國(guó)應(yīng)對(duì)未來(lái)國(guó)際爭(zhēng)端解決的策略。
[Abstract]:With the increasing probability of international disputes in the field of economic and trade, the mechanism of international dispute settlement has become an indispensable international coordination system and a necessary clause in many international agreements. As the world's largest economic organization, the World Trade Organization (hereinafter referred to as "WTO") has a wide range of dispute settlement mechanisms due to its distinctive characteristics. The emergence of the TPP Agreement has promoted a new round of game of global economic and trade rules. In the field of dispute settlement, the nascent conventional dispute settlement mechanism of TPP has achieved some breakthroughs and innovations. They not only bridge the deficiency of the current WTO dispute settlement mechanism, but also promote the deep development of the current regional trade dispute settlement mechanism. This paper intends to analyze the dispute settlement mechanism of TPP and the rules of dispute settlement under the framework of WTO, and make a comparative study in order to grasp the latest development of international dispute settlement mechanism and its long-term influence on the future rules system of international trade. The investor-host country dispute settlement (ISDS) mechanism in international investment agreements (IIAS) has become an indispensable part of contemporary investment agreements, but it also has some institutional and technical defects. In dealing with the issue of investment disputes, many countries pay close attention to it. Analyzing and studying the ISDS mechanism is helpful for China to protect its economic interests in the negotiation of bilateral investment agreements (bits) and to strengthen China's right to speak in the field of formulating new rules for international investment. The first chapter summarizes the dispute settlement mechanism of WTO and NAFTA, the second chapter, the third and fourth chapters elaborate in detail the differences between WTO and TPP dispute settlement mechanism from the aspects of the subject, procedure and implementation measures of the dispute settlement mechanism, and analyze the impact of TPP on WTO. Chapter five analyzes the long-term influence of TPP on the development of international trade rules and China's strategy of dealing with future international dispute settlement.
