【摘要】：農(nóng)產(chǎn)品貿(mào)易一直是國際貿(mào)易領(lǐng)域非常敏感的問題，各國都十分重視對本國農(nóng)產(chǎn)品的保護(hù)，針對農(nóng)產(chǎn)品貿(mào)易的保護(hù)措施層出不窮。烏拉圭回合達(dá)成的《農(nóng)業(yè)協(xié)議》中規(guī)定了對于農(nóng)產(chǎn)品保護(hù)的特殊保障措施，但基于歷史和法律方面的原因，特殊保障措施的適用范圍和條件受到很大限制，對發(fā)展中國家農(nóng)產(chǎn)品的保護(hù)遠(yuǎn)遠(yuǎn)不足，中國亦無權(quán)利使用農(nóng)產(chǎn)品特殊保障措施。多哈回合農(nóng)業(yè)談判中G33集團(tuán)提出了新的農(nóng)產(chǎn)品保障機(jī)制議案以更好地保障發(fā)展中國家農(nóng)產(chǎn)品利益，但是由于各國分歧嚴(yán)重，未能達(dá)成妥協(xié)，這直接導(dǎo)致了多哈回合談判的失敗。雖然現(xiàn)階段談判各方未協(xié)商一致，但相信農(nóng)產(chǎn)品特殊保障機(jī)制議題仍在將來的談判中占據(jù)重要席位。 本文采取通過理論分析以及比較分析相結(jié)合的方法，對現(xiàn)行WTO農(nóng)產(chǎn)品特殊保障措施進(jìn)行了研究，闡述了建立農(nóng)產(chǎn)品特殊保障機(jī)制的必要性，在介紹研究WTO最新主席草案中提議的農(nóng)產(chǎn)品特殊保障機(jī)制基礎(chǔ)上對其不足進(jìn)行分析，就將來我國在農(nóng)產(chǎn)品特殊保障機(jī)制上的立場提出自己的看法。 本文第一部分中介紹了農(nóng)產(chǎn)品特殊保障機(jī)制國內(nèi)外研究現(xiàn)狀，對其中不足之處做了梳理，提出本文所要解決的問題，也即本文的創(chuàng)新之處。 在第二部分中，本文通過對現(xiàn)行農(nóng)產(chǎn)品特殊保障措施立法及實踐現(xiàn)狀的研究提出建立農(nóng)產(chǎn)品特殊保障機(jī)制的必要性； 接下來在第三部分中，，本文系統(tǒng)介紹了農(nóng)產(chǎn)品特殊保障機(jī)制議題談判進(jìn)程以及主要各方觀點，提煉出各方爭議的焦點。隨后在第四部分中對WTO最新主席草案做了分析，指出其對于該機(jī)制議案主體框架的完善之處，并基于該草案的不足之處提出了相應(yīng)的建議； 最后，本文回顧了我國在農(nóng)產(chǎn)品特殊保障機(jī)制議題上的立場，總結(jié)了在談判中中國遇到的主要幾個問題，并結(jié)合中國農(nóng)產(chǎn)品進(jìn)出口現(xiàn)狀針對上述幾個問題提出了相應(yīng)對策建議。
[Abstract]:Agricultural trade has always been a very sensitive issue in the field of international trade. Many countries attach great importance to the protection of their agricultural products, and the protection measures for agricultural products trade emerge in endlessly. The Uruguay Round Agreement on Agriculture provides for special safeguards for the protection of agricultural products, but for historical and legal reasons, the scope and conditions of application of special safeguard measures are greatly limited. The protection of agricultural products in developing countries is far from enough, and China has no right to use special safeguard measures for agricultural products. In the Doha Round of agricultural negotiations, G33 Group put forward a new agricultural security mechanism bill to better protect the agricultural interests of developing countries. However, due to the serious differences among countries, they failed to reach a compromise, which directly led to the failure of the Doha Round negotiations. Although there is no consensus among the parties at the present stage, it is believed that the issue of special safeguard mechanism for agricultural products will still occupy an important position in future negotiations. By combining theoretical analysis and comparative analysis, this paper studies the current special safeguard measures for agricultural products in WTO, and expounds the necessity of establishing special safeguard mechanism for agricultural products. On the basis of introducing and studying the special safeguard mechanism for agricultural products proposed in the latest draft of the Chairman of WTO, this paper analyzes its shortcomings and puts forward its own views on the stand of our country on the special safeguard mechanism of agricultural products in the future. The first part of this paper introduces the domestic and foreign research status of the special safeguard mechanism of agricultural products, combs the deficiencies, and puts forward the problems to be solved in this paper, that is, the innovation of this paper. In the second part, this paper puts forward the necessity of establishing the special safeguard mechanism of agricultural products through the research on the current legislation and practice status of the special safeguard measures of agricultural products; then in the third part, This paper systematically introduces the negotiation process of the special safeguard mechanism for agricultural products and the views of the main parties, and abstracts the focal points of the disputes between the parties. Then in the fourth part, the author makes an analysis of the latest President's draft of WTO, points out its perfection to the main frame of the mechanism motion, and puts forward corresponding suggestions based on the shortcomings of the draft. This paper reviews China's stand on the issue of special safeguard mechanism for agricultural products, summarizes the main problems encountered in the negotiation of China, and puts forward corresponding countermeasures and suggestions for the above problems in light of the current situation of China's agricultural products import and export.
