安理會與武力使用

【摘要】:在聯(lián)合國憲章的框架下,安理會在理論上擁有一系列的權(quán)力與職責。其中最顯著的一項責任就是維護世界和平與安全。與聯(lián)合國大會所不同的是,安理會有權(quán)做出決定,約束聯(lián)合國所有的成員國。安理會主要考慮的是武裝沖突以及其他威脅國際和平與安全的情形與爭端。它有權(quán)作出強制性的制裁行動,呼吁;鸩⑶乙月(lián)合國的名義進行軍事行動。 本文試圖從國際法的視角展現(xiàn)一個真實的安理會,對安理會在傳統(tǒng)的國與國之間的沖突或戰(zhàn)爭中的武力使用情況,以及非傳統(tǒng)情形下的武力使用進行分析,主要包括:安理會授權(quán)使用武力的情況;安理會如何協(xié)調(diào)區(qū)域組織的武力使用問題;維和行動中安理會突破了傳統(tǒng)維和的限制而使用武力的問題以及安理會的非傳統(tǒng)武力使用等方面。從中我們可以發(fā)現(xiàn),雖然安理會在武裝沖突或是戰(zhàn)爭中扮演著重要的角色,擁有獨特的地位,有權(quán)采取武力的措施維持國際和平與安全,但是實際上安理會并不能解決所有的武裝沖突問題,有時甚至走向反面,有損其維護世界和平與安全的形象;并且隨著安理會武力使用的實踐,安理會的作用與責任也產(chǎn)生了一些變化,這些功能上的變化,有的為更好地維護世界和平與安全發(fā)揮了創(chuàng)造性的作用;有的變化則突破了國際法的限制,破壞了國際實踐中確立的基本原則,甚至在某種程度上是國際秩序的一種倒退。 在使用武力維護世界和平與安全的問題上,與其他國際組織以及國家相比,安理會發(fā)揮著不可替代的作用。在安理會框架下授權(quán)成員國家使用武力、開展維和行動、協(xié)調(diào)與區(qū)域組織使用武力的關(guān)系等,是現(xiàn)代國際社會追求世界和平與發(fā)展的有效途徑,否則單邊武力行動必然會泛濫起來,國際社會的和平與安全難以維護。因此,探討安理會與武力使用的關(guān)系,在現(xiàn)代國際社會中有著非常重要的現(xiàn)實意義。
[Abstract]:In the framework of the UN Charter, the Security Council has a series of powers and responsibilities in theory. One of the most obvious responsibilities is to maintain world peace and security. Unlike the United Nations General Assembly, the Security Council has the power to make decisions that bind all members of the United Nations. The Council is primarily concerned with armed conflicts and other situations and disputes that threaten international peace and security. It has the authority to impose sanctions, call for a ceasefire and conduct military operations on behalf of the United Nations. This paper attempts to present a real Security Council from the perspective of international law, analyzing the use of force by the Security Council in traditional conflicts or wars between States, as well as in non-traditional situations. Mainly include: the use of force authorized by the Security Council; how the Council coordinates the use of force in regional organizations; In peacekeeping operations, the Security Council has broken through the restrictions of traditional peacekeeping and used force, as well as the use of non-traditional force by the Security Council. We can see from this that, although the Council plays an important role in armed conflict or war, it has a unique position to take measures of force to maintain international peace and security. But in practice, the Security Council cannot solve all the problems of armed conflicts, sometimes even vice versa, undermining its image of maintaining world peace and security; and with the Council's practice of the use of force, There have also been some changes in the role and responsibilities of the Security Council, some of which have played a creative role in the better maintenance of world peace and security, and some have broken through the limits of international law. It undermines the basic principles established in international practice, and to some extent is a retrogression of the international order. Compared with other international organizations and countries, the Security Council plays an irreplaceable role in the use of force to maintain world peace and security. Authorizing member States to use force, conducting peacekeeping operations, and coordinating relations with regional organizations in the use of force under the framework of the Security Council are effective ways for the modern international community to pursue world peace and development. Otherwise, unilateral force action will inevitably overflow and the peace and security of the international community will be difficult to maintain. Therefore, exploring the relationship between the Security Council and the use of force is of great practical significance in the modern international community.
