【摘要】：近年來(lái),在和平與發(fā)展的大背景下,部分國(guó)家和地區(qū)依然存在動(dòng)蕩,政治形勢(shì)復(fù)雜尖銳,難民規(guī)模不斷擴(kuò)大,特別是隨著歐洲難民潮的爆發(fā),以1951年《關(guān)于難民地位的公約》和1967年《關(guān)于難民地位的議定書(shū)》為核心的國(guó)際難民保護(hù)機(jī)制顯得力有未逮,國(guó)際社會(huì)所面臨的難民問(wèn)題日益嚴(yán)峻并且亟待處理。針對(duì)這一熱點(diǎn)問(wèn)題,本論文擬從國(guó)際法的角度出發(fā),以保護(hù)難民權(quán)利作為核心,參考相關(guān)國(guó)際難民權(quán)利保護(hù)的規(guī)定以及國(guó)際難民權(quán)利保護(hù)的運(yùn)作現(xiàn)狀,發(fā)掘當(dāng)今國(guó)際法在難民權(quán)利保護(hù)方面出現(xiàn)的不足和問(wèn)題,積極探尋緩和甚至根治難民問(wèn)題的解決良方。本文正文部分將分五個(gè)章節(jié)來(lái)對(duì)該問(wèn)題進(jìn)行闡述,具體如下:第一章,從難民的定義,分類和特征三方面對(duì)難民概念加以了解和界定。第二章,關(guān)于難民權(quán)利保護(hù)的綜述,具體包括難民擁有哪些權(quán)利,難民權(quán)利所依托的法律依據(jù)以及難民權(quán)利保護(hù)遵循的原則和實(shí)踐經(jīng)驗(yàn)。第三章,論述難民權(quán)利保護(hù)存在的問(wèn)題,難民權(quán)利保護(hù)在公約制度上存在缺陷,在機(jī)構(gòu)運(yùn)作的實(shí)踐中也存在缺陷。第四章,針對(duì)這些問(wèn)題,應(yīng)當(dāng)加強(qiáng)各單位,各方面的協(xié)調(diào)。提出相應(yīng)的處理對(duì)策。第五章,總結(jié)全文,闡述保護(hù)難民權(quán)利就是保護(hù)人權(quán),難民權(quán)利問(wèn)題是現(xiàn)代文明社會(huì)必須妥善處理的關(guān)鍵所在。
[Abstract]:In recent years, against the background of peace and development, some countries and regions are still in turmoil, the political situation is complex and sharp, and the scale of refugees is constantly expanding, especially with the outbreak of refugee flows in Europe. With the 1951 Convention relating to the status of Refugees and the 1967 Protocol relating to the status of Refugees as the core of the international refugee protection mechanism, the international community is facing increasingly serious refugee problems and needs to be dealt with urgently. In view of this hot issue, this paper intends to take the protection of refugee rights as the core from the perspective of international law, and refer to the relevant provisions of international refugee rights protection and the current situation of the operation of international refugee rights protection. This paper explores the shortcomings and problems in the protection of refugees' rights in international law and actively explores solutions to alleviate or even cure refugee problems. The main body of this paper will be divided into five chapters to elaborate the problem, as follows: the first chapter, from the definition, classification and characteristics of refugees to understand and define the concept of refugees. The second chapter summarizes the protection of refugee rights, including the rights of refugees, the legal basis of refugee rights, and the principles and practical experience of refugee rights protection. The third chapter discusses the problems existing in the protection of refugee rights. The protection of refugee rights has defects in the convention system and in the practice of institutional operation. Chapter IV, in order to solve these problems, we should strengthen the coordination of various units and all aspects. The corresponding countermeasures are put forward. The fifth chapter summarizes the full text, and expounds that protecting refugee rights is protecting human rights, and refugee rights is the key point that modern civil society must deal with properly.
