國際海上貨物運輸中托運人訴權研究

【摘要】:本文著眼于海上貨物運輸中,托運人的訴權問題,主要通過國內外以及國際公約對托運人訴權的立法及學術界相關理論的分析,從理性和實用的角度闡明托運人訴權問題產生的根源及解決思路,在科學理論的支持下,提出可行的實踐操作方案和未來《海商法》關于托運人方面修改的參考性建議。 文章主要采用比較研究的方法,從實踐出發(fā)展開理論分析,注重應然和實然的轉化以及航運實踐中價值的取舍,全面分析和解決托運人訴權問題。 文章分為正文和結論兩大部分,一共三章,具體如下: 第一章介紹了托運人和托運人訴權,以及《海商法》定義的托運人在實踐中帶來的系列問題,進而引出各界對托運人訴權問題的探討。 第二章比較研究了英國法、美國法以及《鹿特丹規(guī)則》起草過程中對托運人訴權的規(guī)定,剖析我國法律規(guī)定的不完善,總結外國法及國際公約中值得借鑒的方面。 第三章詳細分析了現行法律制度下,我國司法界對托運人訴權的不同態(tài)度以及理論界的不同看法,結合典型案例對司法判決及學者觀點進行了分析,并全面討論了提單轉讓后及托運人作為提單持有人時的合同訴權和侵權訴權。 結論部分通過上述探討,提出未來《海商法》修改時關于托運人訴權問題的規(guī)定的參考性建議。
[Abstract]:This paper focuses on the shippers' right of action in the carriage of goods by sea, mainly through the analysis of the legislation of the shipper's right of action and the relevant theories of the academia through the domestic and foreign and international conventions. This paper expounds the origin of the shipper's right of action and its solution from the angle of rationality and practicality. With the support of scientific theory, this paper puts forward the feasible practical operation scheme and the reference suggestions on the modification of shippers in Maritime Law in the future. This paper mainly adopts the method of comparative study, starting from practice to carry out theoretical analysis, pays attention to the transformation of ought and reality and the value choice in shipping practice, and analyzes and solves the problem of shipper's right of action in an all-round way. The article is divided into two parts: the text and conclusion, a total of three chapters, as follows: the first chapter introduces the shipper and shipper rights of action, as well as the definition of "maritime law" shippers in practice brought a series of problems, And then leads to the discussion of the shipper's right of action from all walks of life. The second chapter compares the provisions of the shipper's right of action in the drafting process of English law, American law and Rotterdam rules, analyzes the imperfections of our country's legal provisions, and summarizes the aspects of foreign law and international conventions that are worthy of reference. The third chapter analyzes in detail the different attitudes of the judicial circles to the shipper's right of action and the different views of the theoretical circle under the current legal system, and analyzes the judicial decision and the views of the scholars in the light of typical cases. The contractual right and tort right of bill of lading after the transfer of bill of lading and the shipper as the holder of bill of lading are discussed. Through the above discussion, the conclusion part puts forward some suggestions on the provisions of the shipper's right of action when the Maritime Law is amended in the future.
