【摘要】：本論文由前言、正文和結語三部分構成。前言部分著重闡明中國當前的外國人管理制度相對于經濟社會發(fā)展現(xiàn)狀的嚴重滯后性,指出吸收國際移民法理論,重構中國的外國人管理體系的必要性和緊迫性。 正文分三個部分：第一部分探討中國外國人管理制度的現(xiàn)狀及存在的問題,主要從中國當前出入境制度兩法分立的局面及現(xiàn)行外國人管理制度的滯后性方面進行討論,提出本文的研究對象及要解決的問題。第二部分通過對國際移民法理論及國際移民管理制度的發(fā)展現(xiàn)狀及趨勢進行研究,討論在中國引入國際移民法理論,全面提高中國對于來華外國人的管理水平。第三部分論述筆者對于重構中國外國人管理制度的思考,通過對價值理念、法律體系及體制保障上的重構,實現(xiàn)我國從以出入境管理為核心到全方位動態(tài)管理為目標的轉變,并對中國當前實踐中如何提高外國人管理水平提出建議。 結語部分總結概括全文主要論點,進一步強調中國出入境管理制度的改革方向,依法構建以外國人入出境簽證管理、在華期間日常動態(tài)管理、邊境及國家安全管理為核心的全新外國人管理制度體系。 本文的創(chuàng)新點：筆者主張吸收國際移民管理經驗,改變以出入境管理為核心的外管模式,對來華外國人實現(xiàn)全面動態(tài)管理；主張搭建全國共享的外國人管理信息系統(tǒng),強調各管理部門間的協(xié)調配合,發(fā)揮各自的業(yè)務優(yōu)勢,而非僅將外管權限集中于某一部門；提出在我國推行IC卡居留許可制度的構想,以落實住宿登記制度,加強對來華外國人的動態(tài)管理。筆者還建議完善外管工作立法,如正式賦予基層民警對外國人的盤查權力,加大對“三非”的處罰力度等。
[Abstract]:This thesis consists of three parts: preface, text and conclusion. The preface emphasizes on the serious lag of the current foreigner management system in China in relation to the present economic and social development, and points out the necessity and urgency of absorbing the theory of international migration law and reconstructing China's foreigner management system. The text is divided into three parts: the first part discusses the current situation and existing problems of China's alien management system, mainly from the current situation of separation of the two methods of entry and exit system in China and the lagging aspects of the current alien management system. The research object of this paper and the problems to be solved are put forward. In the second part, by studying the current situation and trend of international immigration law theory and international migration management system, the author discusses the introduction of international migration law theory in China to improve the management level of foreigners in China. The third part discusses the author's thinking on reconstructing the management system of foreigners in China. Through the reconstruction of the value concept, legal system and system guarantee, the author realizes the transformation from the core of entry and exit management to the all-directional dynamic management. Suggestions on how to improve the management level of foreigners in China's current practice are put forward. The conclusion summarizes the main points of the full text, further emphasizes the direction of the reform of China's entry and exit management system, establishes the administration of entry and exit visas for foreigners according to law, and daily dynamic management during their stay in China. Border and national security management as the core of the new foreign management system. The innovation points of this paper are as follows: the author advocates to absorb the experience of international migration management, to change the mode of foreign administration with the core of entry and exit management, to realize the comprehensive and dynamic management of foreigners coming to China, and to set up a nationwide shared information system on foreigners' management. Emphasizing the coordination and coordination among the various management departments, giving full play to their respective business advantages, rather than concentrating the competence of the outside administration on one sector, and proposing the idea of implementing the IC card residence permit system in China in order to implement the registration system of accommodation, We will strengthen the dynamic management of foreigners coming to China. The author also suggests to perfect the legislation of foreign administration, such as giving the basic police the power to check foreigners, and increasing the punishment of "three non-feats" and so on.
