【摘要】：國(guó)際統(tǒng)一私法協(xié)會(huì)正在制訂《移動(dòng)設(shè)備國(guó)際利益公約——空間資產(chǎn)特定問(wèn)題議定書(shū)》,以調(diào)整以所有權(quán)保留、物上擔(dān)保以及租賃等方式進(jìn)行的空間資產(chǎn)融資。議定書(shū)起草過(guò)程已耗時(shí)十年,目前在空間資產(chǎn)的定義和范圍,用于提供公共服務(wù)的空間資產(chǎn)的融資中出現(xiàn)違約情形時(shí)對(duì)違約救濟(jì)的限制,議定書(shū)與聯(lián)合國(guó)外層空間條約體系規(guī)則的關(guān)系等問(wèn)題上仍存在較大爭(zhēng)議,甚至導(dǎo)致議定書(shū)的起草過(guò)程陷入僵局。這些爭(zhēng)議問(wèn)題體現(xiàn)了國(guó)家利益的博弈以及債權(quán)人與國(guó)家利益的沖突。中國(guó)雖積極參加了議定書(shū)的起草工作,但是國(guó)內(nèi)規(guī)范衛(wèi)星產(chǎn)業(yè)的實(shí)體和程序性規(guī)則距離空間商業(yè)化利用所需規(guī)范還有很大差距。
[Abstract]:The International Association for private law is working out the Convention on the international interests of mobile equipment, the protocol on specific issues of space assets, to regulate the financing of space assets in such ways as retention of title, security and leasing. The process of drafting the protocol has taken ten years and is currently used to provide public services in the definition and scope of space assets. There are still great disputes on the relationship between the protocol and the rules of the United Nations system of outer space treaties, which even lead to a deadlock in the drafting process of the protocol. These disputes reflect the game of national interests, as well as the interests of the creditors and the state. Conflict. Although China has actively participated in the drafting of the protocol, there is still a big gap between the substantive and procedural rules of the domestic standardization of the satellite industry and the requirements for the commercial utilization of space.
