【摘要】：用運(yùn)輸合同權(quán)利讓渡、利他或法律規(guī)定來闡釋提單持有人的權(quán)利來源愈來愈無法適應(yīng)提單實(shí)踐活動(dòng)的需求,將提單法律關(guān)系與海上貨物運(yùn)輸合同關(guān)系相區(qū)分,構(gòu)建合理的提單法律關(guān)系理論,以有效指導(dǎo)提單立法及司法實(shí)踐,已是無法回避的問題�；诖�,本文界定了提單法律關(guān)系概念內(nèi)涵,對(duì)提單法律關(guān)系類屬及法律根據(jù)進(jìn)行了辨析,探討了提單法律關(guān)系理論構(gòu)建的核心問題,即提單法律關(guān)系與其基礎(chǔ)原因法律關(guān)系之間的效力聯(lián)系如何?本文主張應(yīng)借鑒物權(quán)法律關(guān)系無因性,將物權(quán)法律關(guān)系與其原因債權(quán)法律關(guān)系的調(diào)整方法,擴(kuò)展適用于提單領(lǐng)域,確認(rèn)提單法律關(guān)系的相對(duì)無因性,以有效實(shí)現(xiàn)提單的經(jīng)濟(jì)功效,契合提單立法目的。
[Abstract]:It is more and more difficult to explain the rights of the holder of a bill of lading by means of the transfer, altruism or legal provisions of the contract of carriage. The legal relationship between the bill of lading and the contract of carriage of goods by sea is distinguished from the demand of the practical activities of the bill of lading. It is an unavoidable problem to construct a reasonable theory of legal relationship of bill of lading to guide the legislation and judicial practice of bill of lading. Based on this, this paper defines the concept of legal relationship of bill of lading, analyzes the category and legal basis of legal relationship of bill of lading, and probes into the core problem of the construction of legal relationship theory of bill of lading. What is the relationship between the legal relationship of bill of lading and the legal relationship of its underlying reasons? This paper argues that we should use the legal relationship of real right for reference, adjust the legal relationship of real right and its reason creditor's rights, extend it to the field of bill of lading, and confirm the relative uncausality of the legal relationship of bill of lading. In order to realize the economic effect of bill of lading, it accords with the legislative purpose of bill of lading.
