【摘要】：由于風(fēng)險(xiǎn)預(yù)防在不同的環(huán)境議題下,有著不同的運(yùn)行方式和方法,所涉及的利益沖突也不同,所以本文主要從國(guó)際法律文件中風(fēng)險(xiǎn)預(yù)防的條文入手,采用歷史研究和比較研究的方法,將風(fēng)險(xiǎn)預(yù)防放在氣候變化領(lǐng)域中,以研究它的特殊性。 本文由前言、正文、結(jié)語(yǔ)三部分組成。 本文前言部分介紹了風(fēng)險(xiǎn)預(yù)防的含義、產(chǎn)生背景、風(fēng)險(xiǎn)預(yù)防在國(guó)際環(huán)境法上的地位、在國(guó)際社會(huì)存在的爭(zhēng)議以及本文的研究方向。 正文第一章是風(fēng)險(xiǎn)預(yù)防的基本理論,立足于國(guó)際法律文件中關(guān)于風(fēng)險(xiǎn)預(yù)防的條文,介紹了風(fēng)險(xiǎn)預(yù)防的起源和確立,以及國(guó)際社會(huì)對(duì)風(fēng)險(xiǎn)預(yù)防的爭(zhēng)議和態(tài)度。第二章是風(fēng)險(xiǎn)預(yù)防在氣候變化領(lǐng)域中的適用,重點(diǎn)分析了風(fēng)險(xiǎn)預(yù)防在應(yīng)對(duì)全球氣溫變暖、保護(hù)臭氧層、防止大氣跨界污染這三個(gè)法律體系中的體現(xiàn)和特點(diǎn)。第三章結(jié)合了前兩章的分析,指出了氣候變化領(lǐng)域中風(fēng)險(xiǎn)預(yù)防的問題并針對(duì)這些問題提出了建議。第四章是風(fēng)險(xiǎn)預(yù)防對(duì)我國(guó)應(yīng)對(duì)氣候變化的影響,論述了風(fēng)險(xiǎn)預(yù)防的理念在我國(guó)法律中的體現(xiàn),并分析了對(duì)我國(guó)法律、經(jīng)濟(jì)、能源安全和科學(xué)技術(shù)上的挑戰(zhàn)。 結(jié)論部分指出對(duì)風(fēng)險(xiǎn)預(yù)防的解釋總是帶有主觀性,這與各國(guó)的國(guó)家利益是分不開的,我國(guó)是一個(gè)能源結(jié)構(gòu)以煤炭為主、應(yīng)對(duì)氣候變化能力相對(duì)較弱的發(fā)展中國(guó)家,我國(guó)不宜承認(rèn)風(fēng)險(xiǎn)預(yù)防的國(guó)際習(xí)慣法地位。
[Abstract]:Since risk prevention has different operating methods and different conflicts of interest under different environmental issues, this paper mainly starts with the provisions on risk prevention in international legal documents. By using the method of historical and comparative research, risk prevention is put into the field of climate change to study its particularity. This paper consists of three parts: preface, text and conclusion. The preface of this paper introduces the meaning of risk prevention, its background, the status of risk prevention in international environmental law, the controversy in the international community and the research direction of this paper. The first chapter is the basic theory of risk prevention. Based on the articles on risk prevention in international legal documents, it introduces the origin and establishment of risk prevention, as well as the controversy and attitude of the international community on risk prevention. The second chapter is the application of risk prevention in the field of climate change, focusing on the analysis of risk prevention in the response to global warming, the protection of the ozone layer, the prevention of transboundary air pollution, the embodiment and characteristics of the three legal systems. Chapter three combines the analysis of the first two chapters, points out the problems of risk prevention in the field of climate change, and puts forward some suggestions for these problems. The fourth chapter is the impact of risk prevention on climate change in China. It discusses the embodiment of the concept of risk prevention in China's laws, and analyzes the challenges to our law, economy, energy security and science and technology. The conclusion points out that the interpretation of risk prevention is always subjective, which can not be separated from the national interests of various countries. China is a developing country whose energy structure is dominated by coal and its ability to cope with climate change is relatively weak. China should not recognize the international customary law status of risk prevention.
