【摘要】：第一次世界大戰(zhàn)后，國際聯(lián)盟、國際勞工組織等重要的、具有普遍性的國際組織出現(xiàn)，國際組織在國際社會中發(fā)揮的作用日益重要起來。第二次世界大戰(zhàn)后，聯(lián)合國的成立更加標(biāo)志著國際組織的發(fā)展進(jìn)入一個全新的階段。同時，隨著歐洲統(tǒng)一思潮的推進(jìn)，從最初的歐洲煤鋼共同體、歐洲原子能共同體和歐洲經(jīng)濟(jì)共同體，到歐洲共同體，再到歐洲聯(lián)盟的成立，歐盟作為區(qū)域性國際組織取得了飛速的發(fā)展。學(xué)界對其研究也不斷深入。筆者結(jié)合國際法學(xué)、國際政治的研究方法，以此為研究的創(chuàng)新點(diǎn)，一方面從國際法層面梳理國際組織法律人格的相關(guān)學(xué)說、歐盟法律人格的發(fā)展脈絡(luò)，另一方面又從國際政治全球治理層面以諸多案例探討了歐盟對內(nèi)、對外的國際關(guān)系。筆者最終希望通過文獻(xiàn)解讀、實(shí)例分析為中歐關(guān)系的發(fā)展提供新的思路。 本文共分為四章： 第一章探討國際組織的法律人格問題。本章結(jié)合國際組織的發(fā)展歷史，綜合考察了國際組織法律人格問題的發(fā)展過程。接著，筆者以國際法上著名的三派學(xué)說——約章授權(quán)說、隱含人格說、客觀人格說為核心，分別探討了他們對國際組織法律人格來源的分析及優(yōu)劣。同時，本章也結(jié)合了國際法院對國際組織法律人格的司法實(shí)踐，進(jìn)而奠定本文的理論基礎(chǔ)，，即以“約章授權(quán)說”為基礎(chǔ)，并吸取了其他學(xué)說的合理因素。 第二章梳理歐盟的法律人格問題發(fā)展脈絡(luò)。本章以歐盟成立以來的所有條約為研究藍(lán)本，包括《馬斯特里赫特條約》、《阿姆斯特丹條約》、《尼斯條約》、《歐盟憲法條約》、《里斯本條約》等。從國際法層面采用文本分析的方法研究條約的內(nèi)容，并采用比較分析的方式探究歐盟法律人格問題的發(fā)展脈絡(luò)，同時探討了默示法律人格和明示法律人格、單一法律人格和多樣法律人格等問題。 第三章分析《里斯本條約》關(guān)于歐盟法律人格以及相關(guān)事項(xiàng)的新發(fā)展及其局限性和不足�！独锼贡緱l約》規(guī)定歐洲聯(lián)盟正式取代歐共體，取消了歐盟三大支柱的架構(gòu)，并以單一的法律人格參與國際事務(wù)。同時，也加大了歐盟在締約權(quán)問題上的靈活性和廣泛性，規(guī)定了歐洲理事會主席和外交與安全政策高級代表的對外代表權(quán)，眾多改革措施一定程度上有助于加強(qiáng)歐盟在國際舞臺上的力量和聲音，對歐盟參與全球治理產(chǎn)生了影響。但是，文章也分析了歐盟內(nèi)部對于歐盟單一法律人格以及由此帶來的一體化后果和未來發(fā)展的終極目標(biāo)還存在著非常大的分歧，因此導(dǎo)致了《里斯本條約》仍有其局限性和不足。 第四章考察歐盟法律人格確認(rèn)后對其參與全球治理的影響。文章從《里斯本條約》生效后的典型案例出發(fā)，以敘利亞危機(jī)歐盟及其成員國的表現(xiàn)探討《里斯本條約》的對內(nèi)影響，以氣候議題中歐美關(guān)系及戰(zhàn)略安全中歐盟與北約關(guān)系探討《里斯本條約》的對外影響。同時，文章綜合分析了里斯本時代中歐關(guān)系中可預(yù)見的問題，尤其是人權(quán)問題。認(rèn)為中國在注重研究歐盟整體的、統(tǒng)一的對外政策的同時，還應(yīng)側(cè)重于發(fā)展在歐盟眾多事項(xiàng)表決中有主導(dǎo)權(quán)的大國（如德國、法國）和利用較小的成本發(fā)展同歐洲小型國家的關(guān)系。
[Abstract]:After the First World War , the international union , the International Labour Organization and other important and universal international organizations have emerged , and the role of international organizations in the international community has become increasingly important . At the same time , the establishment of the United Nations marked the development of international organizations in the international community . At the same time , with the establishment of the European Union , the European Union has gained rapid development from the first European coal and steel community , the European Atomic Energy Community and the European Economic Community .

This article is divided into four chapters :

Chapter One discusses the legal personality of international organizations . This chapter , in combination with the development history of international organizations , comprehensively investigates the development process of legal personality of international organizations .

The second chapter deals with the development of the legal personality of the European Union . All the treaties since the founding of the European Union have been the basis of the study , including the Treaty of the Treaty of the European Union , the Treaty of Amsterdam , the Treaty of Venice , the Constitutional Treaty of the European Union and the Treaty of Lisbon , etc . The contents of the treaty are studied from the perspective of international law , and the development of the legal personality of the European Union is explored by means of comparative analysis , and the problems such as the legal personality of implied legal personality and the personality of the legal personality , the single legal personality and the various legal personality are discussed .

Chapter III analyzes the new developments and limitations and shortcomings of the European Union ' s legal personality and related matters . The Treaty of Lisbon provides that the European Union will formally replace the European Community , eliminate the three pillars of the European Union and participate in international affairs with a single legal personality . At the same time , the EU has also strengthened the EU ' s power and sound in the international arena , which has influenced the European Union ' s participation in global governance . However , the article also analyzes the internal EU ' s unique legal personality and the ultimate goal of future development , which has led to its limitations and shortcomings .

Chapter IV examines the impact of EU legal personality upon its participation in global governance . In the light of the typical case of EU and its member States , the article discusses the internal influence of the Treaty of Lisbon on the relations between the European and American relations and strategic security . At the same time , the article comprehensively analyzes the foreseeable problems in the European and American relations and strategic security of the European Union , especially the human rights .
