【摘要】：電子數(shù)據(jù)從產生之初,人們一直都在質疑它的真實性。雖然海事電子數(shù)據(jù)僅為電子數(shù)據(jù)中的一類,但諺語有云"麻雀雖小,五臟俱全",其在司法運用中有著與一般電子數(shù)據(jù)證據(jù)相同的要求。以海事電子數(shù)據(jù)為視角研究質疑電子數(shù)據(jù)真實性問題,不僅能為海事司法實踐提供理論支持,還可從研究中尋找一般電子數(shù)據(jù)的普遍性適用規(guī)則。
[Abstract]:From the beginning of the generation of electronic data, people have been questioning its authenticity. Although the maritime electronic data is only one of the electronic data, the proverb "although the sparrow is small, all the organs are well", it has the same requirements as the general electronic data evidence in the judicial application. To study the authenticity of electronic data from the perspective of maritime electronic data can not only provide theoretical support for maritime judicial practice, but also seek universal applicable rules for general electronic data.
