【摘要】：2010年4月20日,位于墨西哥灣的“深水地平線”鉆井平臺(tái)發(fā)生溢油事故,并造成了美國(guó)歷史上最嚴(yán)重的鉆井平臺(tái)油污事故,而據(jù)調(diào)查這次事故是完全可以避免的。美國(guó)對(duì)BP開出的天價(jià)罰單也看出了此次事故的嚴(yán)重性。本文的寫作靈感正是源于墨西哥灣的“深水地平線”溢油事故和隨后的大連石油管道爆炸事故,隨著近海石油開發(fā)事業(yè)的發(fā)展,其所帶來的油污風(fēng)險(xiǎn)也在不斷加大,而近岸鉆井平臺(tái)由于其位于直接開采石油的環(huán)節(jié)所造成的油污損害要比油輪的大多,目前國(guó)際上和我國(guó)國(guó)內(nèi)對(duì)近岸鉆井平臺(tái)的立法規(guī)制卻又不是十分完善。雖然國(guó)際上有許多調(diào)整由于船舶造成油污損害賠償問題的公約和國(guó)內(nèi)立法等,但關(guān)于近岸鉆井平臺(tái)的公約國(guó)內(nèi)法卻很少,因此有必要對(duì)由于近岸鉆井平臺(tái)造成油污的損害賠償問題進(jìn)行分析,尋求解決近岸鉆井平臺(tái)造成油污的損害賠償問題之路。 本文緒論部分介紹了目前近岸鉆井平臺(tái)的基本情況并對(duì)墨西哥灣“深水地平線”油污事故進(jìn)行了簡(jiǎn)單梳理,并介紹了近岸鉆井平臺(tái)造成油污的嚴(yán)重性以及對(duì)其造成損害的相關(guān)問題進(jìn)行簡(jiǎn)要分析。第一章對(duì)近岸鉆井平的范圍界定進(jìn)行分析,從國(guó)際公約,還是組織立法和國(guó)內(nèi)法的方面進(jìn)行對(duì)比,并探究了鉆井平臺(tái)和船舶的區(qū)別以及在國(guó)際法和國(guó)內(nèi)法中的實(shí)踐。第二章則重點(diǎn)分析了近岸鉆井平臺(tái)造成的損害和責(zé)任問題,從近岸鉆井平臺(tái)造成損害的國(guó)際法責(zé)任和對(duì)損害范圍的界定進(jìn)行分析,主要對(duì)損害問題進(jìn)行了論證。第三章對(duì)近岸鉆井平臺(tái)造成油污的損害賠償問題進(jìn)行論證,從賠償責(zé)任性質(zhì),賠償主體,賠償范圍和賠償限額等方面展開論述,并對(duì)比了國(guó)際法,美國(guó)的相關(guān)規(guī)定和我國(guó)當(dāng)前的制度。第四章則是對(duì)油污損害賠償基金的分析,從國(guó)際油污損害賠償基金,美國(guó)油污損害賠償基金和我國(guó)的油污損害賠償基金制度的對(duì)比出發(fā),探究油污損害賠償基金對(duì)近岸鉆井平臺(tái)的適用問題。最后結(jié)論部分通過對(duì)全文的總結(jié),提出了對(duì)我國(guó)建立近岸鉆井平臺(tái)造成油污的損害賠償制度的有關(guān)建議。
[Abstract]:The oil spill at the Deepwater Horizon rig in the Gulf of Mexico on April 20, 2010, caused the worst oil spill in the history of the United States. The severity of the accident was also seen by the sky-high US fine on BP. The inspiration of this paper is from the Deepwater Horizon oil spill accident in the Gulf of Mexico and the subsequent oil pipeline explosion in Dalian. With the development of offshore oil development, the oil pollution risk is also increasing. Because the offshore drilling platform is located in the link of direct oil exploitation, the oil pollution damage caused by the offshore drilling platform is much more than that of the oil tanker. At present, the legislative regulation of the offshore drilling platform is not perfect in the world and in our country. Although there are many international conventions and domestic legislation regulating compensation for oil pollution damage caused by ships, there are few domestic laws on offshore drilling platforms. Therefore, it is necessary to analyze the problem of compensation for oil pollution caused by offshore drilling platform, and to seek a way to solve the problem of compensation for oil pollution caused by offshore drilling platform. The introduction part of this paper introduces the basic situation of offshore drilling platform and briefly combs the oil pollution accident of Deepwater Horizon in the Gulf of Mexico. The seriousness of oil pollution caused by offshore drilling platform and the related problems of damage caused by it are briefly analyzed. The first chapter analyzes the definition of the scope of offshore drilling flat, compares the international convention, organization legislation and domestic law, and probes into the difference between drilling platform and ship and the practice in international law and domestic law. The second chapter focuses on the analysis of damage and liability caused by offshore drilling platform, and analyzes the international liability of damage caused by offshore drilling platform and the definition of damage scope, and mainly demonstrates the damage problem. The third chapter demonstrates the problem of compensation for oil pollution caused by offshore drilling platform, discusses the nature of liability, the main body of compensation, the scope of compensation and the limit of compensation, and compares international law. The relevant regulations of the United States and the current system of our country. The fourth chapter is the analysis of the oil pollution damage compensation fund, starting from the comparison of the international oil pollution compensation fund, the United States oil pollution damage compensation fund and the oil pollution damage compensation fund system of our country. To explore the application of oil pollution damage compensation fund to offshore drilling platforms. Finally, through the summary of the full text, the paper puts forward some suggestions on establishing the damage compensation system for oil pollution caused by offshore drilling platform in China.
