【摘要】：以國(guó)際和各國(guó)國(guó)內(nèi)國(guó)際空間站損害責(zé)任的法律規(guī)范與制度為研究對(duì)象,旨在以外層空間法學(xué)為視角,通過(guò)規(guī)范分析和對(duì)比分析的方法,力圖為中國(guó)空間站相關(guān)立法提供參照。國(guó)際空間站損害責(zé)任制度的法律包含國(guó)際法律框架和國(guó)內(nèi)法律框架兩個(gè)層面。外空條約為空間站的損害責(zé)任制度的構(gòu)建提供了重要的基礎(chǔ)和制度參考,《國(guó)際空間站政府間協(xié)議》和政府間的諒解備忘錄豐富了空間站損害責(zé)任的國(guó)際法律制度,成為國(guó)際法律框架的重要?jiǎng)?chuàng)新和補(bǔ)充。在國(guó)際法律制度的基礎(chǔ)上,各主要空間國(guó)家結(jié)合各國(guó)國(guó)情創(chuàng)建其相關(guān)國(guó)內(nèi)立法,其中創(chuàng)新性的法律制度更具實(shí)踐意義,不僅為國(guó)際空間立法提供了有益借鑒,也對(duì)中國(guó)空間站立法有重要的啟示作用。隨著中國(guó)空間科學(xué)的進(jìn)步和綜合國(guó)力的提升,中國(guó)也逐漸參與到空間站的建設(shè)中來(lái),也不得不面對(duì)空間站的損害問(wèn)題。對(duì)于中國(guó)空間站立法而言,結(jié)合中國(guó)的空間站立法狀況,中國(guó)有必要對(duì)空間站的損害責(zé)任問(wèn)題從主體、歸責(zé)原則、責(zé)任承擔(dān)方式、求償路徑和保險(xiǎn)要求五個(gè)方面對(duì)其進(jìn)行制度構(gòu)建,以減少空間活動(dòng)中的損失,保證空間站的正常運(yùn)行,真正實(shí)現(xiàn)為人類謀福祉的目標(biāo)。
[Abstract]:Taking the legal norms and systems of international and national international space station liability for damage as the object of study, the purpose of this paper is to make reference to the relevant legislation of China's space station through normative analysis and comparative analysis from the perspective of outer space law. The law of ISS liability system includes two aspects: international legal framework and domestic legal framework. The outer space treaty provides an important basis and institutional reference for the construction of the space station's liability regime for damage, and the Intergovernmental Agreement on the International Space Station and the intergovernmental memorandum of understanding enrich the international legal regime for damage liability of the space station, To become an important innovation and supplement to the international legal framework. On the basis of the international legal system, the major space countries create their relevant domestic legislation in the light of the national conditions of each country, in which the innovative legal system is more practical and not only provides useful reference for international space legislation, Also has the important enlightenment function to the Chinese space station legislation. With the progress of space science and the improvement of China's overall national strength, China has gradually participated in the construction of the space station, and has to face the problem of damage to the space station. As far as China's space station legislation is concerned, it is necessary for China to deal with the damage liability of the space station from the subject, the principle of imputation, and the way of assuming the responsibility, in the light of the legislative situation of China's space station. In order to reduce the loss in space activities, ensure the normal operation of space station and realize the goal of human welfare, the claim path and insurance requirements are constructed in five aspects.
