【摘要】：如今世界經(jīng)濟(jì)飛速發(fā)展,食品貿(mào)易領(lǐng)域一直在擴(kuò)大,伴隨著的食品安全問題已經(jīng)發(fā)展成一個(gè)全球性問題。各國(guó)為了保護(hù)自身利益,制定了許多嚴(yán)格的食品安全法律法規(guī)和相關(guān)的檢驗(yàn)檢疫措施,然而這種嚴(yán)苛的措施在一定程度上阻礙了國(guó)際貿(mào)易自由化發(fā)展進(jìn)程。WTO作為最大國(guó)際組織之一,在食品安全的全球治理中也發(fā)揮著相當(dāng)重要的作用。WTO為了發(fā)揮自身優(yōu)勢(shì),更好地解決食品安全問題,制定了與食品安全有關(guān)的《技術(shù)性貿(mào)易壁壘協(xié)議》(簡(jiǎn)稱《TBT協(xié)議》)和《實(shí)施衛(wèi)生與植物衛(wèi)生措施協(xié)議》(簡(jiǎn)稱《SPS協(xié)議》)。本文的研究有如下四個(gè)部分:第一部分是國(guó)際貿(mào)易下食品安全問題的簡(jiǎn)單介紹,分別對(duì)食品和食品安全的定義進(jìn)行說明和界定,并分析食品安全與國(guó)際貿(mào)易之間存在的密切聯(lián)系和沖突,為下文進(jìn)一步研究食品安全的法律問題奠定基礎(chǔ)。第二部分是關(guān)于WTO對(duì)食品安全的法律規(guī)制�！禨PS協(xié)議》中的科學(xué)依據(jù)、風(fēng)險(xiǎn)評(píng)估、符合國(guó)際標(biāo)準(zhǔn)、透明度原則對(duì)各成員國(guó)食品安全機(jī)制的形成起到了關(guān)鍵的作用�！禩BT協(xié)議》中的食品安全技術(shù)法規(guī)和合格評(píng)定程序,也是食品安全中特別重要的規(guī)則。對(duì)這兩個(gè)協(xié)議中的重點(diǎn)規(guī)則進(jìn)行分析有助于更好地利用WTO規(guī)則來保護(hù)各國(guó)食品安全,同時(shí)也盡可能減少國(guó)際貿(mào)易當(dāng)中食品安全貿(mào)易壁壘。第三部分詳細(xì)分析我國(guó)在執(zhí)行WTO框架下食品安全相關(guān)規(guī)則中存在的問題。我國(guó)自加入WTO以來,積極履行了 WTO有關(guān)協(xié)議義務(wù),并結(jié)合具體國(guó)情實(shí)施了與食品安全有關(guān)的法律法規(guī)。但是,我國(guó)在履行WTO食品安全的規(guī)則方面存在著一些問題,這些問題主要是我國(guó)對(duì)國(guó)際標(biāo)準(zhǔn)的適用程度不夠,風(fēng)險(xiǎn)評(píng)估機(jī)構(gòu)設(shè)置不夠健全,動(dòng)植物檢疫范圍相對(duì)狹窄,透明度原則履行中的“模糊化”。第四部分主要論述針對(duì)我國(guó)在執(zhí)行WTO框架下食品安全相關(guān)規(guī)則中存在的問題,提出解決的對(duì)策建議:健全我國(guó)食品安全標(biāo)準(zhǔn)體系、建立合理的食品安全風(fēng)險(xiǎn)評(píng)估制度、適當(dāng)調(diào)整動(dòng)植物檢疫的范圍,健全食品安全的信息化管理制度、充分利用WTO規(guī)則解決爭(zhēng)端。
[Abstract]:With the rapid development of the world economy, the field of food trade has been expanding, and the food safety problem has developed into a global problem. In order to protect their own interests, various countries have formulated many strict food safety laws and regulations and relevant inspection and quarantine measures. However, to some extent, this stringent measure has hindered the development of international trade liberalization. As one of the largest international organizations, WTO also plays a very important role in the global governance of food safety. The Agreement on Technical barriers to Trade (TBT Agreement) and the Agreement on the implementation of Sanitary and Phytosanitary measures (SPS Agreement) related to food safety have been formulated. This paper has four parts as follows: the first part is a brief introduction of food safety under international trade, which explains and defines the definition of food and food safety respectively. It also analyzes the close relationship and conflict between food safety and international trade, which lays a foundation for further research on the legal issues of food safety. The second part is about the legal regulation of WTO on food safety. The scientific basis of the SPS Agreement, the risk assessment, conforms to the international standards. The principle of transparency plays a key role in the formation of food safety mechanism in all member countries. The technical regulations and conformity assessment procedures of food safety in TBT Agreement are also the most important rules in food safety. The analysis of the key rules of the two agreements will help to make better use of the WTO rules to protect the food safety of all countries, and at the same time reduce the food safety trade barriers in international trade as much as possible. The third part analyzes the problems existing in the implementation of food safety rules under the framework of WTO in China. Since China's entry into WTO, China has actively fulfilled its obligations under the relevant WTO agreements, and has implemented laws and regulations related to food safety in the light of the specific national conditions. However, there are some problems in the implementation of WTO food safety rules in China. These problems are mainly due to the inadequate application of international standards, the inadequate establishment of risk assessment institutions, and the relatively narrow scope of animal and plant quarantine. Ambiguity in the implementation of the principle of transparency. The fourth part mainly discusses the problems existing in the implementation of the food safety rules under the framework of WTO in China, and puts forward some countermeasures and suggestions: perfecting the food safety standard system and establishing a reasonable food safety risk assessment system. Adjust the scope of animal and plant quarantine properly, perfect the information management system of food safety, make full use of WTO rules to resolve disputes.
