【摘要】：本文主要有6個(gè)部分組成。第一部分對(duì)危險(xiǎn)廢物越境轉(zhuǎn)移的法律控制進(jìn)行概述,具體講述其概念,范疇,性質(zhì),現(xiàn)狀等內(nèi)容。并且將該方面因素與相關(guān)判例相結(jié)合進(jìn)行分析。第二部分,主要分析了我國(guó)面臨的危險(xiǎn)廢棄物轉(zhuǎn)移的現(xiàn)狀。第三部分和第四部分分別在國(guó)際法和國(guó)內(nèi)法兩個(gè)角度針對(duì)廢棄物的轉(zhuǎn)移的法律控制進(jìn)行了對(duì)比和講解。主要對(duì)侵權(quán)責(zé)任的承擔(dān),刑事責(zé)任以及相關(guān)司法實(shí)踐進(jìn)行描述。在國(guó)際法調(diào)解方面,主要對(duì)《巴塞爾公約》進(jìn)行分析。第五部分,主要描寫(xiě)跨境環(huán)境損害的責(zé)任認(rèn)定和賠償問(wèn)題。并對(duì)責(zé)任的性質(zhì),責(zé)任承擔(dān)方式等進(jìn)行研究。最后,具體講述了目前處理危險(xiǎn)廢物越境轉(zhuǎn)移的新形式。本文主要研究跨國(guó)環(huán)境損害的責(zé)任承擔(dān)以及實(shí)踐。大致可以分為兩個(gè)主體框架。前者為,對(duì)整個(gè)跨境污染問(wèn)題進(jìn)行總體的詮釋和描述,后者側(cè)重于對(duì)跨國(guó)環(huán)境損害責(zé)任分擔(dān)進(jìn)行研究和比較。研究的重點(diǎn)主要集中在對(duì)越境危險(xiǎn)廢物越境轉(zhuǎn)移的實(shí)體法上面,例如責(zé)任分擔(dān)的原則及其依據(jù),判決的承認(rèn)和執(zhí)行,本文也研究了侵權(quán)行為地法原則以及軟化規(guī)則運(yùn)用于環(huán)境侵權(quán)訴訟當(dāng)中。本文旨在研究各個(gè)國(guó)際公約及其各國(guó)相關(guān)司法的基礎(chǔ)上推動(dòng)國(guó)內(nèi)侵權(quán)和國(guó)內(nèi)研究上做出些許研究。
[Abstract]:The first part is composed of 6 parts. The first part is a summary of the legal control of the transboundary movement of hazardous wastes, and specifically describes its concept, category, nature and status. The second part analyses the present situation of the transfer of hazardous waste in China. The third part is mainly about the status of the transfer of hazardous wastes in China. And the fourth part, respectively, in the two aspects of international law and domestic law, respectively, to compare and explain the legal control of the transfer of waste. It mainly describes the responsibility of the tort liability, the criminal responsibility and the relevant judicial practice. In the field of international law mediation, the Basel convention is mainly analyzed. The fifth part is mainly about the cross border ring. The responsibility identification and compensation problem, the nature of responsibility and the way of responsibility bearing, and so on. Finally, the new form of dealing with the transboundary movement of hazardous wastes is specifically described. This paper mainly studies the responsibility and practice of transnational environmental damage. It can be divided into two main bodies. The former is the whole cross-border pollution. The problem carries out a general interpretation and description. The latter focuses on the study and comparison of the responsibility sharing of transnational environmental damage. The focus of the study is mainly on the substantive law on transboundary transboundary transfer of hazardous wastes, such as the principle and basis of responsibility sharing, the recognition and implementation of the judgment, and the principle of the law of torts. And the rules of softening are used in environmental tort litigation. This article aims to study the domestic torts and domestic research on the basis of the international conventions and their respective countries' related judicature.
