ECFA框架下海峽兩岸私法沖突問題研究

【摘要】:2010年6月29日,海峽兩岸正式簽訂了《海峽兩岸經濟合作框架協(xié)議》(即ECFA), ECFA的最終簽署是兩岸關系和平發(fā)展的一個重要里程碑。自上世紀40年代開始,由于特殊的歷史原因,兩岸交往被人為隔絕。直到上世紀70年代末,在大陸政府的不懈努力下,海峽兩岸之間的交往,從無到有,日益密切。但是由于兩岸社會制度、法律制度的不同,這必然會導致大量民商事法律沖突的產生。ECFA的簽署使兩岸經貿往來進一步深化,因此探討海峽兩岸的民商事法律沖突的解決具有極其重要的意義。 筆者試圖從國際私法角度找到一條有效解決現(xiàn)階段兩岸民商事法律沖突的途徑。本為在寫作上分為四部分:第一部分對ECFA的簽署背景、必要性以及發(fā)展前景進行簡單介紹,通過類比CEPA(即“關于建立更緊密經貿關系的安排”)和FTA(即“自由貿易協(xié)定”)明確界定了ECFA的法律屬性,即在“一個中國”前提下的特殊國內法律安排。第二部分著重對海峽兩岸私法沖突的性質進行界定。通過對海峽兩岸私法沖突產生原因及性質進行分析,闡明海峽兩岸私法沖突實際上是特殊的區(qū)際法律沖突。第三部分則分節(jié)探討了ECFA框架下海峽兩岸在旅游、空運直航、知識產權保護以及商業(yè)銀行法律制度這四個領域的私法沖突問題,說明了兩岸私法沖突問題亟待解決。最后一部分,通過研究當前各多法域國家解決區(qū)際法律沖突所采取的方式,結合我國海峽兩岸私法沖突的特殊性,提出解決海峽兩岸私法沖突的切實有效方法。 目前解決海峽兩岸私法沖突的方法有很多,但是究竟應該采取何種方法,應當結合海峽來兩岸私法沖突的特點。在“一個中國”、“一國兩制”的前提下,筆者認為解決海峽兩岸私法沖突的方法是:一是簽署國際私法協(xié)議;二是類推適用各自國際私法。
[Abstract]:On June 29, 2010, the two sides of the Taiwan Strait formally signed the Framework Agreement on Economic Cooperation between the two sides of the Taiwan Strait. The final signing of the ECFA is an important milestone in the peaceful development of cross-strait relations. Since the 1940s, due to special historical reasons, cross-strait exchanges have been artificially isolated. Until the late 1970s, with the unremitting efforts of the mainland government, the exchanges between the two sides of the Taiwan Strait grew closer from scratch. However, due to the different social systems and legal systems across the Taiwan Strait, this will inevitably lead to the emergence of a large number of conflicts of civil and commercial laws. The signing of ECFA will further deepen cross-strait economic and trade exchanges. Therefore, it is of great significance to discuss the conflict of civil and commercial laws between the two sides of the Taiwan Strait. The author tries to find an effective way to solve the conflict of civil and commercial laws between the two sides of the strait from the angle of private international law. This paper is divided into four parts: the first part introduces the background, necessity and development prospect of ECFA. By analogy with CEPA (the CEPA on the Establishment of closer Economic Partnership) and FTAs (Free Trade Agreement), the legal attributes of the ECFA are clearly defined, that is, special domestic legal arrangements under the premise of "one China". The second part focuses on defining the nature of the conflict between the two sides of the strait. Based on the analysis of the causes and nature of the conflict between the two sides of the Taiwan Strait, this paper expounds that the conflict between the two sides of the Taiwan Strait is actually a special interregional conflict of laws. The third part discusses the conflict of private law between the two sides of the Taiwan Strait in the four fields of tourism, direct air transportation, intellectual property protection and the legal system of commercial banks under the framework of ECFA, which shows that the conflict of private law between the two sides of the strait should be solved urgently. In the last part, the author puts forward the effective method to solve the conflict of private law between the two sides of the Taiwan Strait by studying the ways adopted by the countries in various jurisdictions to solve the conflict of laws between the two regions, and combining with the particularity of the conflict of private law between the two sides of the Taiwan Strait. There are many ways to resolve the conflict between the two sides of the Taiwan Strait, but what methods should be adopted, which should be combined with the characteristics of the conflict between the two sides of the strait. Under the premise of "one China" and "one country, two systems", the author thinks that the solution to the conflict of private law between the two sides of the Taiwan Strait is as follows: first, signing an agreement on private international law; secondly, applying their private international law by analogy.
