【摘要】：本文分析了TRIPS協(xié)定產(chǎn)生的動(dòng)因，歸納、闡明了協(xié)定中與發(fā)展中國(guó)家密切相關(guān)的重要內(nèi)容及影響；同時(shí)，筆者就發(fā)展中國(guó)家履行協(xié)定提出了自己的建議。 本文首先介紹了論文的研究背景和目的。第二章分析了TRIPS協(xié)定產(chǎn)生的動(dòng)因，并指出知識(shí)產(chǎn)權(quán)制度在概念以及運(yùn)行上出現(xiàn)的主要變化。同時(shí)也對(duì)一直伴隨著協(xié)定議定過(guò)程中的非對(duì)等性進(jìn)行了簡(jiǎn)要論述。第三章概述了構(gòu)建起協(xié)定最低標(biāo)準(zhǔn)框架的部分重要條款。第四章著重考量了TRIPS協(xié)定給發(fā)展中國(guó)家?guī)?lái)的一些影響。TRIPS協(xié)定的生效實(shí)施對(duì)發(fā)展中國(guó)家的本地創(chuàng)新、技術(shù)轉(zhuǎn)讓、外國(guó)直接投資（FDI）和對(duì)外貿(mào)易等社會(huì)經(jīng)濟(jì)發(fā)展的方方面面都具有重大影響。而且,由于行業(yè)、產(chǎn)業(yè)不同以及各類別知識(shí)產(chǎn)權(quán)間的差異，協(xié)定對(duì)其產(chǎn)生的影響程度也是各不相同的。由于篇幅所限，本文僅以三個(gè)關(guān)鍵的領(lǐng)域?yàn)槔齺?lái)解釋產(chǎn)生的影響，即：藥品、軟件以及植物新品種。TRIPS協(xié)定對(duì)于各國(guó)在這些領(lǐng)域的立法自由都予以了不同程度的限制，本文旨在闡明發(fā)展中國(guó)家應(yīng)當(dāng)如何分析協(xié)定對(duì)其國(guó)內(nèi)產(chǎn)生的影響，進(jìn)而在可能的范圍內(nèi)做出最優(yōu)化決策。第五章就筆者選取的一些重點(diǎn)問(wèn)題和行業(yè)，通過(guò)對(duì)協(xié)定相關(guān)內(nèi)容的解讀，提出發(fā)展中國(guó)家履行協(xié)定最低標(biāo)準(zhǔn)的策略建議。第六章是筆者簡(jiǎn)明扼要地歸納了本文得出的主要結(jié)論。
[Abstract]:This paper analyzes the causes of the TRIPS agreement and summarizes the important contents and influences which are closely related to the developing countries in the agreement. At the same time, the author puts forward his own proposals for developing countries to fulfill the agreement.
This paper introduces the research background and purpose. The second chapter analyzes the causes of the TRIPS agreement produced, and pointed out that the main changes of the intellectual property system in concept and on the run. At the same time also has been accompanied by an agreement agreed in the process of non reciprocity gives a brief discussion. The third chapter summarizes the important part of building in terms of standard framework of minimum agreement. The fourth chapter focuses on the consideration of the TRIPS agreement for developing countries to bring some impact force of the.TRIPS agreement the implementation of local innovation and technology transfer to developing countries, foreign direct investment (FDI) has the significant influence to foreign trade and other aspects of social and economic development. Moreover, because of different industries, industry and the differences between the categories of intellectual property, the influence degree of agreement for the emergence of the same. Because of the limited space, this paper only takes three key. Domain as an example to explain the influence, namely: pharmaceuticals, software and new varieties of plants.TRIPS agreement for all countries in the fields of legislation freedom to a different level, this paper aims to clarify the developing countries should how to analyze the impact of the agreement, and then make the optimal decision in the possible range of some key issues. And the fifth chapter selected by the author, by interpreting agreements related content, this agreement minimum standard strategy in developing countries. The sixth chapter is the main conclusions the author summed up the concise and to the point.
