【摘要】：目前,有關(guān)涉外金融衍生產(chǎn)品交易的沖突法律和法律適用,各國(guó)法律規(guī)定甚少,理論研究也較落后。文章針對(duì)這種現(xiàn)象,選擇了金融衍生產(chǎn)品交易較為發(fā)達(dá)的美國(guó)作為范本,結(jié)合近現(xiàn)代沖突法理論,嘗試提出金融衍生產(chǎn)品交易糾紛的管轄法院。
[Abstract]:At present, there are few laws and regulations on the conflict law and legal application of foreign financial derivatives trading, and the theoretical research is relatively backward.In view of this phenomenon, this paper chooses the United States, where the financial derivatives trade is more developed, as a model, and tries to put forward the jurisdiction court of the financial derivative trading dispute combining with the modern conflict law theory.
