【摘要】：當今之國際社會,跨國犯罪日益猖獗,犯罪嫌疑人、犯罪分子往往通過各種途徑逃至國外以逃避法律的制裁。為了有效遏制這種勢頭,需要世界各國的通力合作。作為國際社會打擊跨國犯罪的重要手段,引渡制度已經(jīng)在世界大多數(shù)國家建立起來,我國也不例外。但是隨著國際形勢的變化與國際引渡合作的廣泛開展,我國引渡制度中的一些問題已經(jīng)顯現(xiàn)出來并日漸成為我國與國際社會開展引渡合作的障礙,因此有必要對我國的引渡制度加以完善以便更好地發(fā)揮它的作用。 本文主要分為三個部分,第一部分主要介紹國際引渡制度的基本內(nèi)容,涉及了國際引渡制度的基本概念、歷史發(fā)展以及基本內(nèi)容。在第二部分中,對國際引渡制度的最新發(fā)展與動向做了分析與說明,在國際引渡制度發(fā)展的最前沿,查尋國際引渡制度的最新發(fā)展成果,重點對引渡制度中的“條約前置主義”、簡易程序的適用及幾個主要原則做深入考察與分析,以此為中國引渡制度的完善路徑提供參考依據(jù)。在本文的第三部分中,筆者主要從兩個方面展開探析,首先是將中國引渡制度的基本框架和其中存在的問題做了闡釋,其次對完善我國引渡制度進行了系統(tǒng)性構(gòu)想,此也是本文的重點內(nèi)容之所在�？傊�,筆者希望以此微薄的獻言,進一步提升中國引渡立法的立法質(zhì)量,使我國引渡法律制度上升到一個新的高度,使我國的引渡制度與國際引渡制度更好的銜接,同時不喪失本身的立場,不損害中國的國家利益,以更順暢的引渡罪犯,實現(xiàn)引渡的立法目的。本文以國際刑法關(guān)于引渡的基礎(chǔ)理論為研究起點,通過對于國外引渡合作的新發(fā)展以及我國引渡制度現(xiàn)狀的分析,找出我國引渡制度存在的問題與不足,進一步提出針對性的完善措施。
[Abstract]:Nowadays, transnational crime is rampant day by day in the international community, criminal suspects and criminals often escape to foreign countries through various ways to escape the sanction of the law.In order to effectively curb this momentum, the cooperation of all countries in the world is required.As an important means of combating transnational crime, extradition system has been established in most countries in the world, and China is no exception.However, with the change of international situation and the extensive development of international extradition cooperation, some problems in China's extradition system have emerged and become an obstacle for China to carry out extradition cooperation with the international community.Therefore, it is necessary to improve the extradition system in order to play a better role.This paper is divided into three parts. The first part mainly introduces the basic content of international extradition system, involving the basic concept, historical development and basic content of international extradition system.In the second part, the latest development and trend of international extradition system are analyzed and explained. In the forefront of the development of international extradition system, we find out the latest development achievements of international extradition system.The emphasis is on the "treaty preposition" in the extradition system, the application of the summary procedure and several main principles, so as to provide a reference for the perfection of the extradition system in China.In the third part of this paper, the author mainly analyzes from two aspects. Firstly, it explains the basic frame of China's extradition system and the existing problems, and secondly, it makes a systematic conception to perfect the extradition system of our country.This is also the focus of this article.In a word, the author hopes to further improve the legislative quality of China's extradition legislation, raise the extradition legal system of our country to a new height, and make the extradition system of our country better link up with the international extradition system.At the same time, it does not lose its own position, does not harm China's national interests, in order to facilitate the extradition of criminals, to achieve the legislative purpose of extradition.Taking the basic theory of international criminal law on extradition as the starting point, through the analysis of the new development of foreign extradition cooperation and the present situation of extradition system in China, this paper finds out the problems and shortcomings of extradition system in our country.Further put forward targeted improvement measures.
