【摘要】：近年來(lái),跨境數(shù)據(jù)流動(dòng)規(guī)制問(wèn)題引起了廣泛關(guān)注。實(shí)際上跨境數(shù)據(jù)流動(dòng)規(guī)制已經(jīng)有30多年的發(fā)展歷史,并演化出分別由歐盟和美國(guó)主導(dǎo)的兩套規(guī)制體系。但全球?qū)用娴囊?guī)制卻存在"三難選擇",無(wú)法同時(shí)兼顧"良好的數(shù)據(jù)保護(hù)""跨境數(shù)據(jù)自由流動(dòng)"和"數(shù)據(jù)保護(hù)自主權(quán)"。在此框架下,規(guī)制目標(biāo)之間的平衡、參與主體之間的競(jìng)爭(zhēng)以及規(guī)制本身對(duì)約束力和執(zhí)行力的訴求構(gòu)成了推動(dòng)規(guī)制演進(jìn)的三重因素。結(jié)合這些規(guī)律,中國(guó)應(yīng)借鑒歐盟與美國(guó)的規(guī)制方法,推進(jìn)國(guó)內(nèi)規(guī)制實(shí)踐,確立最合適的規(guī)制模式,盡快參與規(guī)制競(jìng)爭(zhēng)。
[Abstract]:In recent years, the regulation of cross-border data flow has attracted wide attention.In fact, the regulation of cross-border data flow has been developed for more than 30 years, and two regulatory systems led by the European Union and the United States have evolved.However, there are "three difficult choices" in the regulation at the global level, which can not take into account "good data protection", "cross-border data free flow" and "data protection autonomy" at the same time.In this framework, the balance between the objectives of regulation, the competition among the participants, and the demands of the regulation itself on the binding and executive power constitute the triple factors to promote the evolution of regulation.In combination with these laws, China should draw lessons from the regulation methods of EU and America, promote domestic regulation practice, establish the most appropriate regulatory model and participate in regulatory competition as soon as possible.
