【摘要】：在全球政府信息公開(kāi)及環(huán)境保護(hù)立法快速發(fā)展的大背景下,我國(guó)已在政府環(huán)境信息公開(kāi)領(lǐng)域開(kāi)展了立法和實(shí)踐,尤其是2008年5月實(shí)行的《環(huán)境信息公開(kāi)辦法(試行)》,更是這一領(lǐng)域的專(zhuān)門(mén)性立法。但是,通過(guò)與歐盟政府環(huán)境信息公開(kāi)立法體系比較發(fā)現(xiàn),我國(guó)政府環(huán)境信息公開(kāi)立法存在著諸多問(wèn)題:如環(huán)境信息公開(kāi)的主體范圍過(guò)為狹窄;環(huán)境信息公開(kāi)的客體范圍狹小及環(huán)境信息公開(kāi)救濟(jì)途徑缺乏。本文在借鑒歐盟環(huán)境信息公開(kāi)制度下,提出了完善我國(guó)環(huán)境信息公開(kāi)的幾點(diǎn)建議。
[Abstract]:Under the background of the rapid development of global government information disclosure and environmental protection legislation, China has carried out legislation and practice in the field of government environmental information disclosure.In particular, the implementation of the Environmental Information publicity measures (trial) in May 2008 is a special legislation in this field.However, by comparing with the legislation system of EU government environmental information disclosure, it is found that there are many problems in our government environmental information disclosure legislation: for example, the subject scope of environmental information disclosure is too narrow;The object scope of environmental information disclosure is narrow and the relief way of environmental information disclosure is lacking.Based on the European Union's environmental information disclosure system, this paper puts forward some suggestions on how to perfect our country's environmental information disclosure system.
