【摘要】：通過對TPP知識產(chǎn)權(quán)條款中涉及刑事保護規(guī)則的分析總結(jié),可看出TPP對知識產(chǎn)權(quán)的保護設(shè)置了較TRIPs協(xié)議更高的要求,主要表現(xiàn)在對"商業(yè)規(guī)模"進行了明確的規(guī)定,對盜攝電影的刑事保護提出了強行性要求、針對不同的行為在不同情況下適用何種刑罰和程序進行了明確,在一定程度上擴大了知識產(chǎn)權(quán)刑法保護的范圍。TPP協(xié)議中的這些變化,意味著我國知識產(chǎn)權(quán)刑法保護相關(guān)規(guī)則需要調(diào)整,并且應(yīng)該注意:堅持現(xiàn)有法律體系中有關(guān)"商業(yè)規(guī)模"的規(guī)定;保留關(guān)于刑罰標準和救濟方式的相關(guān)規(guī)定;盜攝電影暫時不納入刑事保護體系;可對進口環(huán)節(jié)的假冒商標行為適用刑事程序和處罰的問題進行規(guī)定,以便與現(xiàn)有海關(guān)執(zhí)法措施有效對接。
[Abstract]:Through the analysis and summary of the criminal protection rules involved in the TPP intellectual property provisions, we can see that TPP has set higher requirements for the protection of intellectual property rights than the TRIPs protocol, which is mainly manifested in the clear provisions on the "commercial scale".It puts forward mandatory requirements for the criminal protection of movie theft, clarifies the penalties and procedures applicable to different acts under different circumstances, and to a certain extent expands the scope of criminal protection of intellectual property rights. These changes in the TPP agreement.This means that the relevant rules of criminal law protection of intellectual property rights need to be adjusted, and that attention should be paid to: insisting on the "commercial scale" provisions in the existing legal system, retaining the relevant provisions on penalty standards and remedies;Theft of films is not included in the criminal protection system for the time being; criminal procedures and penalties can be applied to the import of counterfeit trademarks in order to effectively link up with existing customs enforcement measures.
