【摘要】：正報(bào)復(fù)措施是WTO爭(zhēng)端解決機(jī)制(Dispute Settlement Mechanism)中的最后手段。然而該措施存在不如人意之處,因此有些國(guó)家向GATT和WTO提出過(guò)集體報(bào)復(fù)的設(shè)想。本文擬通過(guò)研究集體報(bào)復(fù)制度提出的背景、借鑒聯(lián)合國(guó)的集體報(bào)復(fù)制度,探討建立
[Abstract]:Positive retaliation is the last resort in the WTO dispute settlement mechanism, dispute Settlement Mechanism.However, the measure is unsatisfactory, so some countries have put forward the idea of collective retaliation to GATT and WTO.This paper intends to study the background of collective revenge system, draw lessons from the collective retaliation system of the United Nations, and explore the establishment of the system of collective revenge.
