【摘要】：隨著經(jīng)濟(jì)全球化步伐不斷推進(jìn),與貿(mào)易有關(guān)的知識(shí)產(chǎn)權(quán)保護(hù)制度從一國(guó)國(guó)內(nèi)保護(hù)漸漸趨向于國(guó)際保護(hù),已有的民事保護(hù)、行政保護(hù)方式已不能滿足知識(shí)產(chǎn)權(quán)貿(mào)易發(fā)展的需要,對(duì)知識(shí)產(chǎn)權(quán)貿(mào)易的保護(hù)方式呈現(xiàn)出“高標(biāo)準(zhǔn)化”趨勢(shì),這將促使刑法保護(hù)手段逐漸地介入到知識(shí)產(chǎn)權(quán)貿(mào)易領(lǐng)域。近些年,我國(guó)知識(shí)產(chǎn)權(quán)貿(mào)易刑法保護(hù)意識(shí)有明顯的提高,截至目前,中國(guó)已基本按世貿(mào)組織的要求建立起較完善的知識(shí)產(chǎn)權(quán)刑法保護(hù)機(jī)制。但是,與《TRIPS協(xié)定》相比,我國(guó)在知識(shí)產(chǎn)權(quán)的立法、執(zhí)法方面仍存在一些問(wèn)題,在國(guó)際知識(shí)產(chǎn)權(quán)貿(mào)易過(guò)程中引發(fā)一系列糾紛。本文從介紹知識(shí)產(chǎn)權(quán)貿(mào)易相關(guān)概念及保護(hù)對(duì)象入手,分析了知識(shí)產(chǎn)權(quán)貿(mào)易刑法介入的原因,隨后對(duì)世界貿(mào)易組織對(duì)知識(shí)產(chǎn)權(quán)貿(mào)易的刑法保護(hù)進(jìn)行梳理,進(jìn)而針對(duì)我國(guó)知識(shí)產(chǎn)權(quán)貿(mào)易刑法保護(hù)現(xiàn)狀中存有的缺陷提出完善建議,以期為我國(guó)知識(shí)產(chǎn)權(quán)貿(mào)易刑法保護(hù)制度的完善有所貢獻(xiàn)。
[Abstract]:With the pace of economic globalization, trade and intellectual property rights protection system from the related domestic protection gradually tend to have international protection, civil protection, administrative protection of intellectual property rights has been unable to meet the needs of development of trade, the trade of intellectual property protection showed a "high standard" trend, which will lead to the protection of criminal law means gradually involved in the trade of intellectual property trade.
