【摘要】：國際投資仲裁起源于國際商事仲裁,卻又因為其往往涉及公共利益而得到更多的第三方關注。在第三方參與呼聲日益高漲的同時,國際上出現(xiàn)了比較豐富的實踐案例。與此同時,聯(lián)合國大會在2013年和2014年相繼通過《投資人與國家間基于條約仲裁透明度規(guī)則》和《聯(lián)合國投資人與國家間給予條約仲裁透明度公約》。雖然目前對第三方參與投資仲裁仍有非議,但不可否認其是大勢所趨,值得我們梳理借鑒。
[Abstract]:International investment arbitration originates from international commercial arbitration, but it gets more and more attention from third parties because it often involves the public interest. At the same time, the voice of third party participation is rising day by day. There have been quite a lot of practical cases in the world. At the same time, The United Nations General Assembly adopted the rules on Transparency in Treaty-based Investor-State Arbitration and the United Nations Convention on Transparency in the granting of Treaty between Investor-State Arbitration in 2013 and 2014 respectively. There is still criticism in the arbitration of capital, But there is no denying that it is the trend of the times, worth combing for reference.
