【摘要】：本文從兼顧保護(hù)農(nóng)民權(quán)益與轉(zhuǎn)基因農(nóng)作物育種人的品種權(quán)的角度出發(fā),研究美國(guó)農(nóng)民留種免責(zé)規(guī)則的基本架構(gòu)。就故意留種行為而言,農(nóng)民有權(quán)不經(jīng)育種人授權(quán)而留存、種植和銷售授權(quán)產(chǎn)品的種子,但繁殖不得超越合理數(shù)量,不得出于商業(yè)目的而繁殖授權(quán)品種、銷售種子的數(shù)量應(yīng)當(dāng)合理。就無意留種行為而言,該行為的侵權(quán)認(rèn)定需要考量農(nóng)民的主觀意圖,損害賠償采取"侵權(quán)收益計(jì)算法"而非"專利損失計(jì)算法"。育種人針對(duì)農(nóng)民留種行為的專利保護(hù)措施有技術(shù)授權(quán)合同的限制條款、終結(jié)者基因技術(shù)等。在此基礎(chǔ)上,指出我國(guó)的立法缺陷包括"專利權(quán)合理容忍限度"的范圍有待辨明,農(nóng)民的無意留種行為與品種權(quán)的沖突解決機(jī)制尚待完善等。
[Abstract]:From the angle of protecting farmers' rights and interests and the breeders' variety rights of genetically modified crops, this paper studies the basic structure of American farmers' exemption rules for keeping seeds. As far as the behavior of intentional seed keeping is concerned, farmers have the right to remain without the authorization of breeders. "to plant and sell seeds of authorized products, provided that reproduction shall not exceed a reasonable number, that authorized varieties shall not be propagated for commercial purposes, and that the number of seeds to be sold shall be reasonable... as far as the act of unintentional seed retention is concerned," The tort determination of this act needs to consider the farmers' subjective intention, and the compensation for damages should be calculated by the method of calculating the revenue of infringement rather than the method of calculating the loss of patent. The breeders' patent protection measures against the farmers' behavior of keeping seeds have the limitation clause of the technical authorization contract. On the basis of this, the author points out that the limitation of our country's legislation includes the scope of "reasonable tolerance limit of patent right" to be identified, and the conflict resolution mechanism between farmers' unintentional seed retention behavior and variety right is still to be perfected, etc.
