【摘要】："伊斯蘭國"的崛起對國際和平與安全構(gòu)成重大威脅,同時(shí)也威脅著美國及俄羅斯等國的利益。2014年8月,以美國為首的聯(lián)盟開始對伊拉克境內(nèi)的"伊斯蘭國"展開軍事打擊,同年9月底又把軍事打擊范圍擴(kuò)展到敘利亞境內(nèi)。一年后,俄羅斯也派軍隊(duì)進(jìn)入敘利亞打擊"伊斯蘭國"。美國為其入敘打擊"伊斯蘭國"所給出的法律依據(jù)是:保衛(wèi)伊拉克的集體自衛(wèi)行動的延伸;敘利亞政府無意愿或無能力有效打擊"伊斯蘭國"。俄羅斯為其入敘打擊"伊斯蘭國"所給出的法律依據(jù)是:受到敘利亞政府的邀請;打擊目標(biāo)僅限于恐怖組織。同為入敘打擊"伊斯蘭國",美俄卻選擇了不同法律依據(jù),其重要原因是兩國圍繞"敘利亞巴沙爾·阿薩德政府是否是合法政府"而進(jìn)行著國際話語權(quán)之爭。這種話語權(quán)之爭從根本上講是"何謂合法政府"這一國際規(guī)范層面問題之爭的外在表現(xiàn),其事關(guān)中國戰(zhàn)略利益,值得中國密切關(guān)注。
[Abstract]:The rise of the Islamic State poses a major threat to international peace and security, as well as to the interests of the United States and Russia. On August 2014, the U.S.-led coalition launched a military strike against the Islamic State in Iraq. At the end of September of the same year, the scope of the military strike was extended to Syrian territory. One year later, Russia also sent troops into Syria to fight the Islamic State. The legal basis given by the United States for its entry into Syria against the Islamic State is: the extension of the collective self-defence action to defend Iraq; The Syrian Government has no will or capacity to effectively combat the Islamic State. Russia's legal basis for its entry into Syria against the Islamic State is: at the invitation of the Syrian Government; The targets are limited to terrorist organizations. The United States and Russia have chosen different legal grounds to join Syria in the fight against the Islamic State. An important reason for this is that the two countries are engaged in an international debate over whether the Syrian government of Bashar al-Assad is a legitimate government, which is fundamentally the international norm of "what is a legitimate government". The external manifestation of the dispute on the plane, It concerns China's strategic interests and deserves China's close attention.
