【摘要】：當(dāng)前,全球經(jīng)濟(jì)進(jìn)入了一體化時(shí)期,各國(guó)經(jīng)濟(jì)飛速增長(zhǎng),在為各國(guó)帶來(lái)利潤(rùn)的同時(shí),也對(duì)環(huán)境造成了嚴(yán)重的污染與破壞。環(huán)境問(wèn)題日益突出,引起了全球人類的高度關(guān)注。在國(guó)與國(guó),地區(qū)與地區(qū)的經(jīng)濟(jì)活動(dòng)日益密切的今天,跨界環(huán)境影響評(píng)價(jià)制度顯得尤為重要�？缃绛h(huán)境影響評(píng)價(jià)制度作為國(guó)際環(huán)境保護(hù)法的一項(xiàng)重要制度,其產(chǎn)生至今已有20多年的歷史,但其實(shí)施現(xiàn)狀卻不盡如人意。“徒法不足以自行”,跨界環(huán)境影響評(píng)價(jià)制度的實(shí)施問(wèn)題不解決,有關(guān)跨界環(huán)境影響評(píng)價(jià)制度的國(guó)際立法便成為一紙空文,該制度預(yù)防跨界環(huán)境損害及保護(hù)環(huán)境的作用也難以發(fā)揮。本文首先介紹了跨界環(huán)境影響評(píng)價(jià)制度的基本內(nèi)容,然后介紹了該制度在的理論研究現(xiàn)狀及實(shí)施中存在的問(wèn)題,進(jìn)行具體分析并提出了解決方案,最后介紹了我國(guó)有關(guān)跨界環(huán)境影響評(píng)價(jià)制度的研究狀況。
[Abstract]:At present, the global economy has entered a period of integration. The rapid economic growth of all countries has brought profits to all countries, but also caused serious pollution and damage to the environment. Has aroused the global human's high attention. In the country and country, the region and the region economic activity is increasingly close today, As an important system of international environmental protection law, transboundary environmental impact assessment system has a history of more than 20 years. However, the present situation of its implementation is not satisfactory. "the law is not sufficient for itself." if the implementation of the transboundary environmental impact assessment system is not resolved, the international legislation on the transboundary environmental impact assessment system will become a dead letter. This paper introduces the basic contents of the transboundary environmental impact assessment system, and then introduces the present situation of the theoretical research and the problems existing in the implementation of the system. At last, the paper introduces the research status of transboundary environmental impact assessment system in China.
