【摘要】：近幾年來,以歐盟、美國(guó)為首的發(fā)達(dá)國(guó)家,對(duì)碳關(guān)稅這一新概念的提出,引起了發(fā)展中國(guó)家對(duì)發(fā)達(dá)國(guó)家以保護(hù)氣候環(huán)境為藉口,變相實(shí)行貿(mào)易保護(hù)主義的高度關(guān)注。如果歐美開征碳關(guān)稅,將極大地沖擊發(fā)展中國(guó)家以高耗能產(chǎn)業(yè)為支柱的企業(yè)對(duì)歐美市場(chǎng)的出口,使對(duì)外貿(mào)易和國(guó)內(nèi)經(jīng)濟(jì)發(fā)展面臨困境。盡管以我國(guó)為主的發(fā)展中國(guó)家已經(jīng)明確反對(duì)歐美開征碳關(guān)稅,但碳關(guān)稅在國(guó)際上是一個(gè)新興且爭(zhēng)議很大的問題,從其性質(zhì)到法律支持,目前都尚無定論。 針對(duì)諸多疑問,本文首先介紹了“碳關(guān)稅”的產(chǎn)生背景及各國(guó)的態(tài)度,并嘗試對(duì)這一有爭(zhēng)議的概念進(jìn)行界定。進(jìn)而對(duì)碳關(guān)稅的性質(zhì)及在WTO框架中的合法性進(jìn)行分析。本文在結(jié)構(gòu)上共分為三章,擬從碳關(guān)稅的背景及問題起源的角度出發(fā),進(jìn)而尋找支撐碳關(guān)稅理論的法律依據(jù),對(duì)碳關(guān)稅的法律性質(zhì)進(jìn)行辨析,最后以我國(guó)所處的視點(diǎn),提出相應(yīng)的應(yīng)對(duì)策略。
[Abstract]:In recent years, the proposed new concept of carbon tariffs in developed countries, led by the European Union and the United States, has caused developing countries to use the protection of the climate environment as an excuse for the developed countries. If the United States and the United States impose carbon tariffs, it will greatly impact the exports to the European and American markets of enterprises in developing countries based on high-energy consumption industries. Foreign trade and domestic economic development are facing difficulties. Although developing countries, mainly China, have clearly opposed the imposition of carbon tariffs by Europe and the United States, carbon tariffs are an emerging and controversial issue in the international community, from their nature to legal support. No conclusion has yet been reached. In view of many questions, this paper first introduces the background of "carbon tariff" and the attitude of various countries. And try to define this controversial concept, and then analyze the nature of carbon tariff and legitimacy in the framework of WTO. This paper is divided into three chapters in structure, from the perspective of the background of carbon tariff and the origin of the problem. Then we seek the legal basis to support the theory of carbon tariff, analyze the legal nature of carbon tariff, and finally put forward the corresponding countermeasures from the point of view of our country.
